The President can't...Whitaker can not move to be the Permanent AG. He was allowed to hold this seat only with certain conditions...and that was one of them.
He's holding the seat for Barr.
Remember, the alternative was the rules of succession which means Rosenstein would have become AG.

I was outside and walked back in and heard shouting from the hearing and wondered WHO it was and it was Collins from GA really raking Nadler over the coals - it was priceless. Nadler was sitting right beside him.
Wish Whitaker could wrap his huge hands around that jerk’s neck...I don’t think he had a clue about what was going on as an aide behind him had to keep reaching over his shoulder to show him something or to clarify something for him. I have to wonder how these people even manage to get to work in the mornings..
