That same statement could have been true 3 weeks ago. He does not have to wait to declare National Emergency. It just gives dems time to prepare response and line up liberal fed judge. Sorry, Trump is not the mastermind you think he is. Consider that, perhaps, Trump knows what he is doing and that you are wrong. That could explain why he is the President and you are an anonymous poster on a web site. I'm going to bet on Trump.

The President will get the wall he wants because it is also what the American people want - especially ME!!!
IMO, He is setting the stage, doing the ground work necessary to call an emergency which requires winning some court battles. He knows exactly what to do.

Again, the 9th Circuit has the worst record at the SCOTUS as far as being overturned is concerned. Its all a matter of lightning quick, expedited appeals to the SCOTUS instead of the glacial pace we used to get from Sessions. The DOJ should already have plotted strategy and tactics even before Trump makes an emergency declaration if he does.
