President Trump says he is considering declaring an emergency at the border to unlock military funds to build a fence (a.k.a. wall).
Its not clear how serious he is, although anonymous White House aides have been quoted saying they believe this will be his ultimate way out of the shutdown fight.
Its a terrible idea. Even if its legal which is unclear, at best it would represent another unwelcome step in Americas long march toward unilateral government by the executive.
The problem isnt declaring an emergency. There is ample authority to do that and we live under a couple of dozen little-noticed declarations of emergency that have accumulated over the decades. The issue is redirecting military funds to the border fence. That would require a strained interpretation that treats the border fence as a military matter, among other legal gymnastics.

NR has long been open borders. Fine, put the ‘coast guard’ on the border. Put camps every mile down the border. Every camp will have walls. Walls to protect the guards. Walls that will cover the entire border.

NRO has no problem with presidents unilaterally sending troops to Middle East in the war on terror. But somehow a president isnt allowed to step up to protect Americas own border

Previous Presidents supported (in word and law) building a fence and shirked their RESPONSIBILITY while they laughed at the gullible citizens.
Previous Presidents also acknowledged a plan to move the US embassy to the capital of Israel and it was President Trump who acted on that agreement.
