Flynn is supposed to be sentenced on tuesday and Mueller has just spit in the judges face and told him it is rain with the Friday response. I don’t think there is going to be a Tueday sentencing but I do think when they are next in court which should be no later than Tuesday that the judge is going to tell the Mueller prosecutors to come back with the stuff he requested or be prepared to spend Christmas in jail for contempt. I don’t really see how he could do anything else. In all likelihood the 302’s were destroyed along with Pientka’s contemporaneous notes which were also subpoenaed. The notes are evidence and the primary evidence that Flynn lied. If they don’t exist the whole basis for bringing the case does not exist. If the prosecutors did not reveal the fact the notes did not exist to defense counsel during disclosure then that is obstruction of justice. I think Mueller is in a world of shit right now.
Now as for what is going on in the DC court rooms let me point out there are two special prosecutors out there. What has John Huber been doing if not looking up Peter Strzok’s ass? Huber was appointed to look into the handling of the Clinton emails and who was in charge of that investigation? Peter Strzok. And who would Mueller really like to keep out from in front of a grand jury right now? And who is a high level government employee with an unlimited budget?
I don’t know what is going on but I read The Prince and I know if you try to kill the king you better not screw it up. There is going to be blood on the floor and a lot of it. Up to now it has been fun and games but from here on out it is kill or be killed.
I really appreciate your comments and insight into the sentencing hearing, and what’s been going on at the DC Circuit. I hadn’t heard about that until the early morning hours of today. All I have been hearing is that Huber hasn’t really done anything, but the cancelling of his appearance with Congress, could well mean that he was busy elsewhere. I’d read he instead made a joint-presentation at some outside meeting. Can’t remember where I read that, but DOJ the statement was made by DOJ Spokeswoman Kerri Kupic. Tried to search anything recent on her, but came up empty.
If Mueller is over a barrel on this, he will turn up the heat in another area.
