Pence Casts Tie-breaking Vote to Confirm Federal Judge

Vice President Mike Pence had to break a tie in the Senate on Tuesday to confirm Jonathan Kobes as a judge on the 8th Circuit Court of Appeals. 

The 50-50 tie came thanks to Sen. Jeff Flake, who joined every Democrat in voting against the nomination. The retiring Arizona senator has vowed to block all judicial picks until the Senate votes on legislation that would protect special counsel Robert Mueller from being fired.

Kobes is the first judge in U.S. history to be confirmed by the Senate with a tie-breaking vote from the vice president, according to CBS News.

The judge was considered to be somewhat controversial after the American Bar Association rated Kobes “not qualified” for the bench, arguing that he has "neither the requisite experience nor evidence of his ability to fulfill the scholarly writing required of a United States Circuit Court Judge.”

The ABA said Kobes, 44, had not submitted enough writing samples to prove he had the professional caliber for the appointment. Most of his writing samples were from his early days as a lawyer or about "relatively simple criminal law matters," and none were "reflective of complex legal analysis," the ABA said. 

"Mr. Kobes is a very accomplished, competent, and capable person, but his career path has not resulted in sufficient evidence of a developed ability to do the written work of a United States Circuit Court Judge," the association said. (CBS News)

Kobes, a Harvard Law School graduate, is the fourth Trump judicial nominee to be confirmed that the ABA rated as “not qualified.”

The point is Flake has no leverage. Even his fellow RINOs are shunning him.

Flake is a man not only without a country, he is a man without a party - all to protect a dirtbag like Mueller.

Good riddance.

Always amuses me cuz it was the Dems who legislated a Majority vote instead of a super majority for Federal judges.

Time to break up the 9th circuit. It's much too big.

And it's time to go to the Supremes about the cr** that a single Federal Judge can stop a NATIONAL case. It makes no sense.

Jeff Flake is deathly afraid of Trump and something in his past is haunting him. There are credible reports that Flake has been actively and personally involved in the volatile politics of Zimbabwe and in its uranium production and sales to Iran. As was McCain.

“Scholarly writing” means making crap up as they go along on the modern courts. It means continuing in the tradition of betrayers to their oaths of office like FDR’s own Justice Roberts.

Yes. A major purpose of a Progressive Supreme Court is to justify violations of the Constitution by the legislature and executive branch.

Another major purpose is to make up law that Progressives want that cannot pass the legislature.

A Third major purpose is to use the Constitution to strengthen Progressive institutions. All the major increases in First Amendment protections from the Court happened as Progressives took over all the major media.

Now, as there is some Conservative media, the First Amendment is falling out of favor with Progressives.

The republicans should also permanently adopt President Trump's rejection of the blue slip custom in the senate. Who knows the ninth circus might actually get some decisions confirmed by the Supremes.

I think it would be Poetic Justice If if Mueller and half of his team of investigators 4 criminally charged for Espionage and Treason over the Uranium One scandal. It’s no coincidence that his Special Counsel team is made up of Deep-State political hacks. Democrats and Never-Trump moderates getting a blank check to go fishing for process crimes.
