The Trump administration on Tuesday formally asked the Supreme Court to block a nationwide ban on the administration's new asylum policy that was unilaterally instituted by a Ninth Circuit Court of Appeals judge last month.
In a November news conference days before the midterm elections, Trump had vowed to turn away all asylum seekers who attempt to cross the border illegally instead of properly presenting themselves at ports of entry.
The president, who has long said the asylum process is rife with fraud, said the emergency policy was necessary as the leading Central American migrant caravan approached the U.S. border with Mexico.
However, U.S. District Judge Jon S. Tigar, who was nominated by President Obama in 2012 to the U.S. District Court for the Northern District of California, issued a temporary restraining order two weeks later that brought a halt to the plan.
Last week, a separate federal appeals court in San Francisco said the ban was inconsistent with federal law and represented an attempted end-run around Congress.
But, the Trump administration said in court papers filed Tuesday that the nationwide order preventing the policy from taking effect "is deeply flawed" and should be lifted pending an appeal that could reach the high court.

The pressure gauge is slowly cranking up and up, it seems.
Today we reached sufficient pressure to use the military to build the wall.
I wonder what level of pressure will be reached when we get to ignoring court orders.
The Court should grant cert, grant a stay, and use this case to curtail district court judges from issuing nationwide injunctions.
I couldn’t agree more, the actions of district court judges are out of control and most are leftists.
I have noticed President Trump does NOT ignore lower court wrong and unconstitutional decisions...He , although it takes longer, goes through the court system LEGALLY to right the liberal judges wrongs...
In other words, he does this the RIGHT way and not like the corrupt previous president, Obama....
Yes, 0bama and his thugs in the executive branch did pretty much what they wanted and most always seemed to to find a way around any ruling they didn’t agree with. Of course they had an easier time of it due to many leftist judges catering to his wishes.

Except it’s not the RIGHT way. He’s ceding the executive power to the courts. Catastrophic damage is being done to what’s left of our constitutional republic.

Yes but there is a lot of risk. If Roberts stabs in the back...again we are screwed but good. Immigration policy has been handed to a wobbly and unreliable Judiciary. Roberts betrayed us when AZ wanted to ENFORCE federal law and smacked the state down. Plus it takes forever. The SC will start by saying the entire 9th must rule then after a year passes they MIGHT take this up or not. Meanwhile the invasion continues.
Ginsburg oughta be gone by then.

Ignore the unconstitutional injunctions-edicts. The courts are not the final arbiter of ‘the law’ or what’s constitutional. If they are, then we might as well let them run everything(which is what’s happening now—judicial tyranny)
