Metairie woman who fatally shot husband released without charges

A Metairie woman who fatally shot her husband has been released from custody without charges. She provided investigators “a detailed and well-documented history of physical and psychological abuse by her husband,” the Jefferson Parish Sheriff’s Office said Saturday (Dec. 8)

Police responded to the shooting Friday just before 9 p.m. in the 2900 block of Transcontinental Drive. The 27-year-old woman had called 911 to report that she had just shot her husband, whom the coroner’s office has identified as Ian Mastin, 27.

Deputies detained her and discovered her husband inside the house with multiple gunshot wounds. He was pronounced dead on the scene.

A Sheriff’s Office spokesman said none of the prior incidents of abuse had been reported to law enforcement. “The woman described hiding the abuse from friends and family but was able to provide a significant amount of corroborating evidence to back her statements,” Capt. Jason Rivarde said.

“The woman stated that another incident of physical abuse occurred through the evening hours yesterday that included escalating altercations and attempted strangulation,” Rivarde said. “Fearing that the years of abuse would culminate in the loss of her life, she shot her husband. She displayed multiple physical injuries that corroborated her account.”

Another example of a man's life worth less than a woman's and different standards for women when accused of a similar crime.

Maybe this guy was an abuser, but she never went to police? She had no other options?

Would be very easy to fake bruises (self inflicted) and literally get away with murder.

If he’s strangling her at the time she shot him I can see how that would be self-defense.

Yes,immediate,grave danger is enough justification for a man,or woman,to kill another person...male or female.But physical and/or psychological "abuse" isn't.

IMO that is.

If abuse can be proven that would be a mitigating factor in determining the severity of a charge as well as determining sentencing but it shouldn't be a get out of jail free card.

I used to know the long time police chief of a small town in Western, North Carolina. He was a really sharp old guy.

Something he told me stuck in my mind. He said women would sometimes push their husband mentally and verbally until he would finally push back. She would then call the police and use the law against him in a divorce.

All she needed was a boyfriend to help her fake the evidence.

Did she do a lie detector? Why no previous attempts to contact police? Why not let the District Attorney’s office decide? Or a jury?

Male lives are devalued by our society at every turn. Women serve a small % of the time fo the same crime men do. Men register for the draft and die in the wars.

Women and men lived to the same age 100 years ago. Now men live 8 years less than women.

Divorce and child custody laws all favor women.

Etc. etc.

We live in a matriarchal society and this is just one example of a dead man nobody cares about.

Reverse the genders and he’d be charged that night.

If you can leave the room and then decide to come back its not a life threatening instance/circumstance. This doesnt change to a lesser standard because you have female genetalia.

What if you have male genitalia but identify as female?

Think they’d care?

If she had the option to leave, not self-defense. Someone being a threat in the future doesn’t equal self-defense.

Id say that depends.

If someone seriously told me theyd murder me in the future and I believed them I would fire upon them right there in self,defense. Or if i saw them coming towards me after saying that. I might even get them before they exited their car in my driveway.

Says she has evidence of past abuse. Some women are too afraid to tell or go to the cops. I knew a woman whose husband would wait until the kids were sound asleep, then beat her body on areas the kids would not be likely to see. She would muffle her screams so the kids wouldn’t hear her. She was too afraid to go to the cops or leave him. I asked her why he was beating her. “ Well, I guess it’s my fault. I guess I just make him mad.”, was her reply. I knew another woman who, as a young woman, had gotten married to a Puerto Rican guy, who was a drug dealer. Like the other woman, he demanded a perfect home. This one was made to keep the house spotless, and wash the walls, floor to ceiling, every week, or get beaten. She also had 2 kids and a full time job, and her husband would clock her drive time, and if she got home one minute past the time he new the drive was, he’d beat her. She finally got away from him. I forget if he went to prison or was killed. She never reported his behavior. She was scared to death of him. I’d like to think if a man beat me, he’d only do it ONCE, but when there are kids involved, I imagine the fear of what might happen to them if he killed you or succeeded in getting your kids away from you, would complicate your actions, to say the least.
Having said all that, if the woman had some kind of documentation that she had been repeatedly abused, she might have been better off to be charged and gotten acquitted. There’s no statute of limitations on murder. I’d hate to have that possibility hanging over my head the rest of my life.
On the other hand, she might have gotten some jurors like a few FReepers here, to whom no woman is any good, it’s always their fault, and they all deserved to be beaten.

A lot of women died in childbirth years ago. My greatgrandfather had 3 or 4 wives, thereby.

Well, I suppose that’s possible. There are a lot of wicked people in this world. I knew another woman, also a nurse like myself and one of the other women was, whose abusive husband shot her in the head when she told him she was leaving him. (You know, the old, “Well if I can’t have you, nobody will”, routine).That bullet was lodged in her head for many years, before the doctor said it had to come out. Apparently they couldn’t remove it when it first happened, but then it began to migrate, and they HAD to get it out. She died of a stroke many years later. Possibly unrelated. She was a smoker.
Those are just 3 women, that I knew of, besides a couple of aunts who had physically abusive alcoholic husbands.
Oh, wait...then there was a close relative, whose boyfriend used to beat her black and blue. Sounds like I had some terrible acquaintances, doesn’t it? Or maybe it’s just a little too common.

I know a man who broke up with a long time girlfriend.

A few weeks later she called him for a ‘no strings attached’ bootie call.

Afterward, she claimed rape.

Hew as in jail for nearly a year on a half million bond he couldn’t afford.

So, sad stories on all sides.

Pardon my female intrusion on the HeMan Women Haters Club but...

Let's assume that, as is generally true, the man is bigger and stronger than the woman. He attacks her, and tries to strangle her. I'm going to assume there was significant bruising on her neck to back up her claim.

He has overpowered her. Unless she's massively trained in self-defense, a weapon is her only force equalizer. Justified.

As for the previous incidents, unless you've either been the abuser or the victim, you wouldn't know that most domestic violence incidents go unreported. Why? because the abuser will take their revenge on the victim for reporting the abuse.

Example - (I am using a man as the abuser, to go along with the “overpowering” scenario. Don't worry, I'll do it with a woman as abuser later on). Joe comes home from work, has a few beers and gets lit. Mary has supper on the table late. Joe starts in on her, verbally abusing her. Mary responds, she doesn't take shit from nobody. Eventually, Joe tires of her and smacks her around a bit. She keeps talking, AS IS HER RIGHT. Finally, Joe has had enough of her mouth and smacks her upside the head with a closed fist.

Mary doesn't call the cops. She doesn't tell her mom or her friends, and she for damn sure doesn't tell her dad or her brothers.

Why doesn't Mary tell? If she told the cops, Joe would go to jail in most jurisdictions if she has physical proof of the abuse. And tomorrow, after Mary posts Joe's bail and he comes home, he'll beat the shit out of her again, because SHE made legal trouble for him.

She doesn't tell her mom cos her mom always said that Joe was a bum, and why did she marry him anyway? Her mom believes that Mary made her bed, now she has to sleep in it.

Mary doesn't tell her friends because she wants them to like Joe. Some of them already suspect that Mary has been lying about the number of times she has walked into a door or fell down the stairs. Besides, if her friends knew Joe was whalin’ on her, they or their husbands would be sure to say something to Joe...and get Mary beat again, for telling.

She doesn't tell her dad or brothers because she figures there is enough violence going on already. Her daddy always said, “If any guy ever lays a hand on my princess I'll beat the living shit out of him!” Her brothers feel the same.

Most of the time, Mary takes pictures of the bruises. She keeps a journal with brief entries- the date, the reason for the fight, and where or with what he hit her. It's all she can do.

One day, Joe gets really extra lit on hooch. And Mary has had a very bad day at work. There's a stack of bills on the table, and the damn bill collector keeps calling.

Mary makes supper and Joe doesn't like what she made. He's cranky. He verbally starts in on her, and she gives as good as she gets. Then Joe starts pulling her hair. Mary knows where this is headed, again. She's had enough. She goes to her nightstand and gets her 9mm Shield. She also grabs her “go bag”, which she keeps in case she has to leave quickly.

Joe has turned on the TV and is stretched out on the couch. Mary tries to sneak out the door. Joe spots her and bounds off the couch. He whips off his belt and yells “Bitch, you ain't goin’ nowhere!” as he runs toward her. He manages to reach the door before Mary and holds it closed as she tries to turn the know. He takes the belt and whips her on the legs. She tells him to stop, she has her gun. He laughs and tells her “ain't no girl gonna beat me!” as he strikes her again and again. She begs him to stop...and he doesn't. After the belt hits her in the face, she draws her gun and points it at Joe. He scoffs and tries to take it from her. Mary pulls the trigger and shoots Joe in the chest. He goes down slowly.

Mary freaks out and tries to stop the bleeding, all the while telling Joe how sorry she is. Joe tells her he loves her and it's ok. Mary then calls 911. Joe survives the ride to the hospital.

Justified?
