Late last night another activist judge, U.S. District Judge Jon Steven Tigar in San Francisco (Obama appointee), issued a temporary restraining order against the Trump administration’s modified emergency asylum policy which barred asylum for aliens who enter the country illegally.
[Read Court Ruling HERE] Setting up, yet again, another likely higher court appeal/decision.
While a challenge was predictable, frustrating and likely to be spun up by media, the ruling only applies to aliens who gain illegal entry and request asylum.
Nothing in the ruling stops the hardened border enforcement and/or current expedited review and deportation program. In essence, keep the illegal aliens out and the judicial ruling is moot (until defeated in higher courts).
Though it might frustrate the left-wing media and the open borders crowd, no court can successfully demand the President of the United States to stop border enforcement. This is why it is critical to have a strong DHS Secretary focused on stopping illegal entry.
This ruling will obviously be appealed by the DOJ; and politically the Democrats realize, in the bigger picture, this ‘open-border’ narrative is not good for them. On its face this ruling is ridiculous as it eliminates/undermines the legal process for asylum requests by removing the distinction of illegal or unlawful conduct in the application process.
Unfortunately, some members of the caravan are purposely causing disruptions at our border ports of entry. There is a legal and illegal way to enter the US. We have deployed additional forces to protect our border. We will enforce all our laws.

That took longer than I expected.
It’s going to the SCOTUS.
The CA federal courts are the most overruled in the country,
Trump could still slow it down to one person a day which would have the same effect.
They aren’t called the ‘Ninth Circus’ for nothing..................
Even according to the high and mighty UN, these invaders do not have a right to asylum in the US.
You are correct, this is rule by judicial fiat. A single judge rules the country on one issue, then another single judge steps up to rule the country on another issue, and on-and-on it goes. These judges must be put back in their Constitutional place.
Court has no standing
When the Supreme Court upheld the Trump Administration on the Travel ban, part of Clarence Thomas opinion addressed the issue of these injunctions being issued by a single federal judge.
Thomas said that the issue of injunctions may need to be examined. Thomas was critical of the fact that the president’s order on the Travel ban had been set aside while it made its way through the court system to the Supreme Court. And he said this is not the way our court system is supposed to adjudicate matter such as this.
So again we see a legitimate presidential order being set aside, perhaps for years, while it works its way through the court system.
I would love to see the Supreme Court set aside this injunction. I don’t know how likely that is however.

Well, I think the Prez could declare a state of emergency and martial law along the border, but he doesn’t want to go there.
When is this feral Nazi bastard going to be arrested for aiding and abetting these criminal, border jumpers? I thought “judges” were supposed to be on OUR side.
The Republican Congress could clear this up in a week or two. The judge is presuming to speak for the intent of Congress when it can speak for itself.
Now that the balance on the SC has shifted, they should create a drive up window. So that every time the Left goes whining to a lower court judge to say they don’t like Trump’s socks today, DOJ can appeal the ruling at the drive through and slap it back in 24 hours. Like the Acosta joke.
Congress can remove any issue from the jurisdiction of the inferior courts. They should certainly do so with immigration law.
The only thing they ever have done it to in my knowledge is tort exemptions for Big Pharma.
The Deep State and Uniparty decided for US back during the GHW Bush administration that we were going to be an hispanic bilingual country whether we like it or not.
Each SCOTUS justice oversees a district. I think the 9th. is overseen by Ginsberg. No way she would ever issue a stay. It’s why they venue-shop it all the time.
Full court hearing and ruling will take at least a year.
The Left knows this.
