Grassley’s Kangaroo Court
National Review ^ | September 22, 2018 6:00 AM | ANDREW C. MCCARTHY

Posted on 09/22/2018 3:52:51 PM PDT by Hojczyk

It’s a kangaroo court.

Understand, this is not about Christine Blasey Ford. She’s a tool — a quite willing tool, but a tool all the same. This is not even about the eminently qualified federal circuit-court judge Brett Kavanaugh — it would be no different regardless of which nominee President Trump selected in consultation with White House counsel Don McGahn, the Federalist Society, the Heritage Foundation, and the rest of the originalist, conservative legal community come of age. Democrats do not want a model of constitutional fidelity and judicial restraint elevated to the Supreme Court. End of story.

And who can blame them? Republicans did not want the eminently qualified federal circuit-court judge Merrick Garland to be elevated to the Supreme Court.

But the Left has turned the High Court into an über-legislature for imposing on the country the social-justice-warrior policy agenda that they cannot ride to victory at the ballot box. The Supreme Court is arguably just as vital to them as winning the White House, because justices often outlast even two-term presidencies by a factor of four or five.

Democrats are willing to use any tactics to block conservatives from the Supreme Court and seat their own ideologues. The question is not “Fair or unfair?” It’s “Will it work?” Republicans always seem flat-footed in response because they underestimate how far Democrats are willing to go to win, how willing they are to destroy people’s reputations if that’s what it takes. Republicans keep thinking it’s 1987 and the Bork debacle was the worst of it; in reality, we’re 30 years on, and the Bork debacle was just the beginning of it.

Maybe Chairman Grassley and his colleagues will figure that out on Thursday. Or is it the next Thursday? Or the day after the midterms? . . .

The Democrats obviously did not learn their lesson in the first Civil War.

I do believe it’s time for a refresher course.

This whole article is spot-on. Our side is digging up old yearbooks. Their side is watching the clock tick down.

A hearing will not change anything except create a spectacle. Grassley, or somebody, needs to end this circus.

.....” Grassley, or somebody, needs to end this circus”....

The fact they could have and haven’t already says they’re playing this as well.

True that Demorats govern by the courts...which is why they worked so hard appointing circuit Judges before Bo left...to use them to stop Trump.....

Everything Obama go he got via the courts..including Supremes...never through Congress..unless at the witching hour like Obamacare.

Hate the fact our governing bodies are operating independently of the people....who see voters as nothing more than to be played and used for a rubber stamp on their offices.

Time will tell...

Could be the greatest 3D chess move ever. Or the greatest example of Republican senate cowardice.

I do know this though. The Democrats can see the big picture. They fully understand the dire consequences to liberalism if Kavanaugh is seated on the court.

With Kavanaugh, it no longer is a court with a swing vote (unless they can cajole Roberts into taking Kennedy's spot). It becomes a 5-4 court and no exercise regiment of RBG's will change this.

They're only hope is taking back the Senate and keeping the seat vacant until after the 2020 elections where they'll either get to confirm a 40-year old radical or a 70-year old moderate.

McCarthy writes well and makes excellent points, but when you look at his underlying premise this article is incoherent.

On the one hand he criticizes the Republicans for being flat-footed in the face of Democrats looking to turn the Kavanaugh confirmation into a loony spectacle, but on the other hand he actually believes that respecting the sanctity of the Senate process will bring an end to the spectacle.

If Kavanaugh is confirmed to a seat on the U.S. Supreme Court in the next couple of weeks, the loony spectacle will only be getting started.

This is where Donald Trump's New York City background comes in handy, and I sincerely hope he and his people are helping the GOP Senators through this process. I can tell you from first-hand experience that there is one extremely effective way to deal with this sh!t -- and I learned this myself from many years in New York City:

Make YOUR loony spectacle even more ridiculous than THEIRS.

I think this is exactly what the Republicans are doing. By letting this thing drag on to the point where it has become even beyond a farce, the Republicans are letting the Democrats turn this spectacle into an awful comedy that nobody wants to watch anymore.

I said last night that the only thing missing from this charade was a laugh track.

Give it another week or two, and even the laugh track will piss off the audience.

This bad show will end when the pathetic clowns are so badly ridiculed that they quit and go home.

Commies don’t want Kavanaugh on the Supreme Court because it will make the court lean right(With Gorsuch it was an even trade) and they are terrified they will lose their precious baby slaughtering rights..meanwhile Grassley is being a major puss for one of two reasons, either A..he doesn’t have the votes, Flake most likely is being a mega prick and will refuse to confirm Kavanaugh, Grassley knows NO Dems will vote for him so he’s basically screwed..or B..Grassley is afraid that the GOP will be screwed in the midterms..which if Grassley were smart he would realize, the morons who are screaming about Kavanaugh will NEVER vote Republican anyway

The seat will not remain vacant until 2020 under any circumstances. I can guarantee you that McConnell will give Trump an opportunity to make a recess appointment in that scenario.

If the Kavanaugh nomination is somehow blocked in 2018, I can easily see an opportunity to put the perfect nominee on the court who would be able to serve until the end of the next Senate term on December 31st, 2020:

JEFF SESSIONS

.... I read somewhere that the Democrat’s actual goal is to get the Confirmation vote pushed past next Thursday after which it will be next to impossible to seat Kavenaugh on the Supreme Court. I don’t know the specifics but I heard it was detailed by Tucker Carlson on his show on FOX News Channel a day or so ago.
