I think you all read this poorly written article wrong. The judge seems to be restating the state agency’s case there, then criticizing it. He allowed the grandparents suit against the state to go forward. It sounds like he agrees with them that the state is acting illegally.

Wow! That judge needs to go. He’s put idealogy over 2nd amendment rights, and threatening the foster parents with the prospect of subjecting an already-traumatized (I’m guessing) child to more pain.

The judge was just restating what the state was arguing. He ruled against them and let the grandparents suit go forward.
