This Cake Baker Won At The Supreme Court. Now The State Is Trying To Get Revenge

Colorado is trying to compel the same baker who just won a Supreme Court case into baking a second cake that violates his religious beliefs.

Masterpiece Cakeshop’s Jack Phillips, who won a Supreme Court case in June, is once again being harangued by the Colorado Civil Rights Commission for refusing to bake a cake with a pro-LGBTQ message. Alliance Defending Freedom filed a federal lawsuit late Tuesday night against the commission on his behalf, over the state’s second attempt to compel him to bake a cake with a message that violates his religious beliefs.

Two months ago, the Supreme Court ruled that Phillips ought not to have been forced to bake a cake with a pro-LGBT message for a same-sex couple’s wedding, because the court found that the commission was overtly hostile to the baker’s religious beliefs.

Masterpiece Cakeshop will happily create custom cakes for anyone. But like many cake artists, Jack cannot create all custom cakes. He cannot create custom cakes that express messages or celebrate events that conflict with his religious beliefs.

This poor man didn’t want an extended battle with the fascist LBGT political wing, but am glad to see he’s not backing down.

I think this is the thing that will actually destroy the Colorado Civil Rights Commission

Freedom of speech is also under attack. This is an issue of compulsory speech - the state is attempting to force him under penalty to utter speech he choses not to utter.

POTUS cannot do anything about this. This is not an Article II situation, and really, we don’t want the POTUS to do anything about this. It’s simply not a Federal Executive power we want.

While POTUS can’t, I think SCOTUS already has helped Jack Phillips. A lot of people say that Phillips’ victory at SCOTUS was a Pyrrhic one, I disagree. The language of the ruling was intentionally narrow, to pretty much apply to the specific case before it. It was also written as the Colorado Civil Rights Commission’s denial of his procedural due process, not a denial of his substantive rights.

However, the language used in the majority opinion makes it clear that the Civil Rights Commission was prejudiced against his religious beliefs. The disparaging language used by members of the Commission comparing Phillips to Nazis speaks for itself. Unless the membership of the Commission has changed, the members showed personal malice and bias against Phillips’ religious beliefs that cannot be erased or ignored. There is no way they can rule against his claim of sincere religious belief and separate out their personal malice. In other words, the SCOTUS ruling gives him all the ammo he needs to show actual malice by the Commission in taking any action against him from this point forward.

And in a Federal District Court, that is pretty much a blank check for Phillips to sue for intentional deprivation of civil rights.

That’s my take anyway.

POTUS can propose legislation to Congress. He has the authority to initiate legislation.

US Senate can step up the pace of confirming conservative judges that POTUS appoints. Change the makeup of Colorado federal courts and it will change the ‘culture’ of legal professionals including state-level courts and attorneys.

Lawyers talk to each other, socialize together, have lunches at the same restaurants, cafes. There is a lot of chatter back and forth in the legal community. Once they sense the ethos has changed or is changing, they usually move with the herd.

The judge assigned this go-round should tell the CO Civil Rights Commission to get the hell out of his/her court.

Once the LGBT’s lose again in court they will resort to vandalism, arson, violence and eventually try to kill Mr. Phillips if they don’t drive him out of business first.
