The White House announced last week that President Trump was considering revoking the security clearances of six former intelligence officials. Law and policy support such revocations, but as the swift and negative reaction in Washington showed, the president must take a nuanced approach.
The legal framework for security clearances was charted by a 1988 Supreme Court decision, Department of the Navy v. Egan. The justices noted that a president has absolute power to grant, deny or revoke access to classified information. This authority is inherent in his role as commander in chief. The court ruled that the president could form due-process procedures for challenging an adverse decisionwhich President Eisenhower first did in 1960but no appeal would be available through the courts.
A body of law and policy has since developed around several key ideas: First, a security clearance should be granted or continued only if it is clearly consistent with the interests of national security. Second, security clearance places an individual into a fiduciary relationship with the government. Third, authorization of access to classified information must be joined with a demonstrated need to know. These widely accepted principles have weathered the passage of time and the scrutiny of Republican and Democratic administrations. Thats because they form sound, nonpartisan policy that furthers the interests of national security.
At some indiscernible point, a special carve-out of the need to know principle developed for those at the top. The idea was that senior administration officials should be allowed to retain their security clearances after leaving government so they could consult with successors as necessary. That makes sense for a brief, defined period. But more than 20 months after the electionwith Obama and Trump officials in a daily cable-news cage fightwhat are the odds that current administration officials consult with their predecessors on anything?

Certain things about Trump I just don’t get. He is forcefully assertive on so many things. Yet when he has the clear authority to declassify crucial documents and immediately strip security clearances from traitors like Brennan and Comey, he just kinda tweets around. Maybe it’s all a matter of timing and effect. But every day Brennan is walking around with a high security clearance is a dangerous day for the US.
All clearances are NEED TO KNOW basis. Explain why Brennan “needs to know” anything about anything these days.
Just because they have security clearances doesn’t mean they need to have access to classified material. Who is giving it to them?

Just listened to a YouTuber today explaining how he believed Trump was setting up Brennan and the rest of them with regards to the security clearances. They were hoping they would snare them using the clearances illegally and they did. Brennan did go to NZ (5 Eyes) and used his clearance for gathering intel on US, which is illegal, thinking there would be no record because thats the way 5 Eyes operates, however, he did leave a trail and Trump has evidence of It. Trump will pull the clearances from all when this sting is complete, according to this video I watched. At least thats the way I recall it.
