Another law in search of a problem.
They can cite one failed and obviously ridiculous attempt to use the described defense.
I don’t think this will pass the “constitutionality” test.
However ridiculous one’s defensive measures in court, it’s up to the jury whether or not it is valid, not congress.
Corporal Klinger defense I guess. This will become a license in your face pervert behavior.

It should be left to juries, not the law, as to what is believable about a defendant’s line of defense. The stupid law should be renamed the “Legal Chains on Juries” law.
The gayest Black guy I’d ever seen was literally prancing though a drug store and he sees me (Black girls are always saying hi to me, something about my look I guess) and lights up and says “Oh HELOOOOOOOOO”. I said hey what’s up and walked away. I was weirded out at the time but in no way was it threatening. It’s funny to think about now.
As for he shes, if you can’t tell she’s a dude, congratulations, you have had too much to drink, need to get your eyes checked, or both.
As for this gay panic defense though, I’d leave it to the jury.
He wasn’t quite as gay looking as that.
