Professor Allan Dershowitz is a civil libertarian, who has been consistent in his opinions throughout his career, regardless of which side of the ideological spectrum the issue in dispute rests.

The man deserves more respect than most of his peers. Even when I disagree with his viewpoint, I give him credit for his consistency in defending civil liberties. As an aside - are you aware that Dershowitz considers Roe v. Wade to be a fundamentally flawed decision?

Think strategically my FRiend. Smart people use the tools/assets they have or can acquire. Likewise, they may decide to abandon certain tactics as ineffective if their portfolio happens to change.

For multiple generations, the proglibs strategically used the SC to achieve difficult legislative policy decisions. It was the perfect technique for the time, but a realistic assessment at this juncture would force any reasonable person to conclude that alternative channels need to be developed.

It just so happens that the left is also desperately looking for some kind of unifying theme to unite an effective electoral coalition. Solution: switch gears by developing a nation-wide constitutional amendment process that democratically codifies the achievements they made through the court system.

What Dersh and other smart prgolibs are suggesting is let the right have the courts. It's gone so far left that all we can do at this point is restore the base line back to constitutional scrutiny. In the meantime, the left has the perfect national plank in which to rally their side to causes they feel are important.

I would think the progs have concluded that 2018 is a lost cause. Therefore, they have 2 years in which to get up to speed in order to have something that generates enough enthusiasm for 2020. Of course, the fly in the ointment is Trump really is a moderate Dem, so while he may not make free choice a campaign issue, it wouldn't surprise me to see him at least neutral.

Plesse, team Obama was very anti-Israel, but comparing them to Hitler is way over the top. Israel is the stumbling stone to having a muslim State of Levant which includes Israel, which was Obama goal...but he wasn’t about to murder 6 million Jews...

The only one on the East Coast who is thought to be a more successful asstriliquist is Justice Ruth Bader “it wasn't me” Ginsburg. Insiders have noted retiring Justice Kennedy's rage from constantly being blamed for “old lady” farts. He protested repeatedly that these actually came from Ginsburg and diabetic Sotomayor after they would come back from a lunch where they feasted together on hard candy and Chili Covered Mango Flavored Lollipops.

It wasn't me.

I give him a lot of credit for speaking the truth...even though it may impact his friendships and his ‘image’. I’ve done it with my friends and family and now I have a little less of both. Sad but liberals really are godless, intolerant, and unforgivable.

Laughed out loud at your post! If Trump is a moderate Democrat then we have nothing to fear from any such.

At any rate I did not follow your logic at all. Of course one uses available weapons and resources. Of course if one thing does not work you use something else. So they used the power of unelected judges and bureaucrats because honest, constitutionally legal procedures did not get them there. Now you think they are going to switch tactics and try to amend the constitution?!

If you don't count the second amendment as a "civil liberty" I guess you could say Dershowitz is "consistent in defending civil liberties".

I count the second amendment as a civil liberty, as does the Constitution.

You see, even while he disagrees with the Second Amendment, yet he still recognizes that the RTKBA is nevertheless in the Constitution, and thus must be defended, despite his personal objections. My point stands.
