Amy Coney Barrett would make a politically shrewd replacement for Justice Kennedy

Michael Brendan Dougherty has some advice for President Trump that I think is worth repeating, in regards to replacing Justice Anthony Kennedy this fall: Appoint Amy Coney Barrett, Trump's recent addition to the 7th Circuit Court of Appeals.

The facts of Barrett’s life — that she is a mother of seven children, and that when she speaks about her Catholic faith, she speaks about God as if she really believes in His existence — will provoke nasty and bigoted statements from Democratic senators and liberal media personalities. Again...It won’t just be her faith. In 2012, a columnist chastised two Republican presidential candidates for their “smug fecundity.” For Barrett, the comments on the number of children she has are likely to be much worse. The fact is that women nominated for positions of authority often inspire hysterical and self-defeating reactions in those who oppose them.

I agree. For one thing, Barrett is only 46 years old and could easily serve on the court until 2060. It also doesn't hurt to put a conservative woman on the court. But in addition, this would be an especially shrewd move ahead of the midterm elections.

As soon as I heard she was on Trump’s “master list” of 25 potential nominees I pegged her as the top contender.

The only thing I care about at her age is if she is a ROCK SOLID Originalist/Constitutionalist who’s judicial ideology make Thomas look moderate.

Another advantage of Judge Barrett. She wasn’t educated in the Ivy League.

Judge Barrett is a Roman Catholic. From a religious perspective the current court is dominated by Catholics and Jews. Judge Gorsuch was raised as a Catholic, but attends an Episcopal Church. Protestants comprise about 50% of the US population. In an era where the Supreme Court continues to hear cases involving freedom of religion, ideally there would be a protestant judge on the court.

She has said that in some cases it might be correct for Catholic judges to recuse themselves from dath penalty decisions.

And even with Kennedy going, the court is still already majority Catholic.

I imagine she’d please Ivanka from among Trump’s list, but I am not so sure she as solidly conservative as some claim.

AND that person has the mettle to stand strong against the inevitable attacks from the left - this is of critical importance.

Lots of ‘good’ people get into government and law. But when the going get tough, they fold; principles go out the window.

*correction* with Scalia’s death and Kennedy’s retirement there are now 4 Catholics on the Court.

Still, only 20% of the country is Catholic and with the pope and US archbishops pulling the Church to the left at a record pace, I am not so sure loading up on Catholics again is a great idea—at least not a positive reason to pick a nominee.

I’d much rather have someone with a ruling on 2A in their background, as I see it as a good test of a person’s views of individual and Constitutional rights. I don’t want Trump to take chances on this.

Much Amy hate here at FR. Some say too many women on the court. She would be an extreme oddity there being the only ProLife woman though. And at 46 she could outlive anyone there

Trump said the list is down to 5 (3 men 2 women). I think two of them are Kavanaugh and Coney-Barrett.

I like that Kavanaugh has written many opinions and we know he isn’t Souter. He is strong on the 2nd Amendment and stayed away from Roe v. Wade. I feel sure he would be a pick similar to Gursuch.

However, Coney-Barrett just recently took the arrows from the fringe left and came through the process with a 55-43 vote. It is the same Congress and she had Donnelly (D-IN), Kaine (D-VA), Manchin (D-WV).

I think you would have a better mid term election impact with her since religious discrimination (1st Amendment) in the courts is front and center. The dems would friggin revolt if she were nominated and show their true hatred of Christians. I think that would energize turnout by Trump supporters more than them going after a white guy having supported gun rights.

Also, I saw somewhere that Kennedy seems to believe there is a greater threat to the 1st Amendment (religious freedom) than the 2nd at this time. I would agree with him if that is the case.

Of these two I would agree with he author David Freddoso.
