The Constitution has fortunately taken care of this.
If the senate is concerned enough, they don’t need to consent to an appointment until the investigation is over. At one time only 41 senators had to be concerned enough, but Reid increased that to 51.
If the house is concerned enough, they can start impeachment proceedings (and confirmation won’t likely have time to happen). And they may just need to threaten impeachment if the senate starts confirmation and not actually start impeachment until more evidence of the investigation is known.
If the people’s representatives (house, senate) aren’t worried enough, an unelected individual (investigator, prosecutor, etc) cannot inhibit presidential actions such as nominating a judge/justice simply by making claims that the people’s representatives are not convinced of. If these individuals could slow down the president, NOTHING WOULD EVER GET DONE.
If Booker is “concerned” he better get on Mueller to release enough evidence to convince 51 senators or the house that Trump is illegitimate. Because short of that, the investigation is Constitutionally meaningless.
He is a drama queen. And maybe not the swiftest......
Recall that Bill Clinton nominated Bryer to the Supreme Court AFTER Ken Starr was appointed to investigate him.
Rush Limbaugh, with half his brain tied behind his back just to make it fair, predicted this would happen on the very day Kennedy said he was retiring. Rush is off today but he will more than likely talk about this on Monday morning.

Cory Booker should receive a letter this afternoon from an official source asking him to substantiate the charge that Trump is a subject of a criminal investigation, since Mueller has said otherwise. If Booker does not respond by cob Monday, he should be subpoenaed by one of the congressional committees paddling in this pond, put under oath, and asked whether he is in receipt of confidential information and from whom.
Senator Booker seems a bit dense, doesn’t he? Why does he think that he can cause the violation of what the Constitution says is to happen? Oh, I forgot, he’s a democrat.
