I see no constitutional support for a “Special Counsel”.
1) If there is reasonable suspicion (RS) or probable cause (PC) of impeachable misconduct or crimes of a high government official, then Congress is in charge of that process and they should hire THEIR OWN investigators that report to CONGRESS.
2) If there is reasonable suspicion (RS) or probable cause (PC) of misconduct or federal crimes of lower government officials or citizens, then the FBI should pursue their normal process of investigation and indictment.
In this case, with RS or PC of the FBI misconduct, then the first alternative listed should be used and Congress should hire THEIR OWN investigators that report to Congress.
I believe it’s trivial exercise that they do. It’s not an explicit enumeration but it seems certain that more would agree it is an implicit right. Congress can delegate,but it can’t give up any of its rights and responsibility. It always owns the product.
