Seventeen Republican lawmakers, led by Rep. Lee Zeldin (R-NY), submitted a resolution Tuesday demanding the appointment of a second special counsel to probe “misconduct” by Justice Department and FBI officials during the 2016 presidential election.

~~~
The 12-page resolution requested the Justice Department to appoint a second special counsel to probe matters associated to three topics: the ending of the investigation into Hillary Clinton’s personal email server, the progress of the Trump-Russia investigation from its “origins through the appointment of Robert Mueller as special counsel, and abuses of the Foreign Intelligence Surveillance Act (FISA) during the warrant application process.”
Good idea or bad idea? Rep. Steve Scalise says it's needed but the key question is.....Will Jeff Sessions approve it?
‘Will Jeff Sessions approve it?’
You’re kidding, right? Sessions has already turned down a previous, similar request. His logic (I kid you not): that what is being done to Trump is so bad, it should never be done to anyone else.
Sessions: the best friend Trump-haters ever had.
Let the IG finish his job and make his recommendations.
Maybe it was the other way around. The collusion investigation was to distract from the deep state activities.
“Will Jeff Sessions approve it? ”
He’d have to be both conscious and competent to do that. So the answer to your question is “No, he won’t.”
Looks like an attempt to keep real work from getting done. And yet, WINNING! Lots of tax dollars being wasted and abused.
The IG doesn’t have the power to subpoena anybody. He is not the one who should be doing this. It needs a prosecutor, but I don’t like these run amok special prosecutors. Surely, there is a federal prosecutor not connected to DC Swamp that could look into this.
Here’s an example of an IG report, “recommendations”, and what happens to recommendations:
https://oig.justice.gov/reports/2018/f180430.pdf
...The Department of Justice (DOJ) Office of the Inspector General (OIG) initiated this investigation after receiving information from the Federal Bureau of Investigation (FBI), Inspection Division, alleging that an FBI Special Agent (SA), who has since retired, may have contacted witnesses during a federal criminal investigation for an improper purpose...
...During the investigation, the OIG also found that the SA divulged law enforcement sensitive information to unauthorized individuals; misused his government issued electronic devices; provided misleading testimony during a related civil deposition; mishandled classified information; misused his position during contacts with local law enforcement officers; and provided false information to the OIG. Criminal prosecution of the SA was declined.
The OIG has completed its investigation and provided its report to the FBI.
I see no constitutional support for a “Special Counsel”.
1) If there is reasonable suspicion (RS) or probable cause (PC) of impeachable misconduct or crimes of a high government official, then Congress is in charge of that process and they should hire THEIR OWN investigators that report to CONGRESS.
2) If there is reasonable suspicion (RS) or probable cause (PC) of misconduct or federal crimes of lower government officials or citizens, then the FBI should pursue their normal process of investigation and indictment.
In this case, with RS or PC of the FBI misconduct, then the first alternative listed should be used and Congress should hire THEIR OWN investigators that report to Congress.
With no power to talk to anyone who has quit the government and now power to prosecute. Yeah, that works well. /s
And how long will this new SC take? Be careful what you ask for - the Dims were (and many still are) all for this current until the info started coming out.
I would say, first let's see what the IG report says. Then, IF there needs to be a second SC, it should be with a very narrow & public scope. Any deviations from the scope should be made public. Progress & budget reports should be made every month.
FTA:
Despite numerous calls from Republican lawmakers, Attorney General Jeff Sessions declined to appoint a second special counsel in March and instead assigned federal prosecutor U.S. Attorney John Huber of the District of Utah to work with Justice Department Inspector General Micheal Horowitz to probe misconduct.
(Emphasis added.)
District of Utah? How will he get jurisdiction to indict, or even subpoena, anybody when all the apparent crimes were mostly committed in DC, NY, or the Northern District of VA and most of the potential defendants live in the same places?
“Let the IG finish his job and make his recommendations.”
We’ve been waiting for this a$$hole to “finish his job” for three or four months now. Screw him! Get on with another SP who has very, very clear marching orders that have been reviewed by President Trump. Horowitz has no teeth, and he’s wasting our time waiting for his tome!
A couple points ... This is political act by a few member of Congress. It simply increases the amount of banter along these lines. This same line was covered in a letter Feb 28, and in a floor speech April 16.
If this H.Res. is voted on, then all of the House will weigh in on the subject, but I seriously doubt this gets put to a vote. The point of this stunt is to get in the news.
BTW, I think it's a good move. Just saying what I see the point of it as.
The other point is that Sessions has the authority to appoint an SC without being goaded by Congress. it is possible but not likely he has already appointed a SC. The regulations allow for such appointment to be made without notification to Congress.
