Trump Orders a Wall Built, but Congress Holds the Checkbook

...On Wednesday [Jan 25, 2017], Mr. Trump signed an [Executive]order to build it [the wall] and announced that work would begin immediately on a project that is estimated to cost more than $20 billion.

He offered few details, including any that would address the fact that Congress, not the White House, writes the checks. The Antideficiency Act prohibits the government from spending money for any reason that Congress has not appropriated.

So is Mr. Trump’s executive order meaningless? Not entirely. The Department of Homeland Security can start planning and discussing the project now and ask for the bulk of the money later. And if Mr. Trump really wants to break ground immediately and avoid Congress, there is — as always in Washington — a workaround that would let him do so at least in theory.

The Feed and Forage Act, first enacted in 1799, was intended to allow military leaders in the field to spend money on essential clothing and medical supplies. But presidents have used that power broadly. Former President George H. W. Bush started the first gulf war under that authority, Mr. Banks said.

In theory, Mr. Trump could order the military to spend extra money to protect national security, then move around the funding within the bureaucracy to pay for a wall built by the Department of Homeland Security, Mr. Banks said. But such an accounting trick has never been used to go around Congress on such a large scale, Mr. Banks said. Lawsuits would be inevitable...

They are going crazy and unfortunately for them as we have discussed in earlier threads that the POTUS holds the checkbook on this Omnibus bill.

Look at DACA, Paris Agreement, Iranian Agreement, etc. as examples how congress can be ignored.

And why does it say a 1.3 trillion dollar budget when we spend like 4 trillion a year?

Lawsuits Trump would win under the separation of powers. Trump can declare a national emergency on the border and use the Army corps of engineers to build the wall as a military project. He can dip into into DOD funds. That’s why bon Friday last he sent congress a letter invoking the 1985 balanced budget and emergency deficit spending bill.

What a strange country we live in where 50% of the population goes berserk when we actually try to determine who is here illegally via the census and we further try to prevent further illegal immigration with a wall. All of these concepts would have met with better than 90% approval just 30 years ago.

So glad that I gave up this subscription years ago. These NY elitists believe that they know best about everything. Luckily, they are not in charge of our food supply. Can you imagine if one of them had to grow a crop or sow a field?

I believe they have identified it by its deficit. I think that’s a 10 year deficit, so that has to be above the normal deficit or none of this makes any sense.

Which maybe it doesn’t. :>)

An Omnibus spending bill is not a budget. Since we have a financial emergency the President used this to get discretionary control over it:
