How could they possibly sue and win over this?

For some bizarre reason, it only takes one rogue judge in some crazy corner of the country to stop the government from functioning.

How could they sue and win? Easy. Take it before an Obama judge, of whom there seem to be plenty. (No Trump judges available since they can’t get confirmed.)

The US solicitor general should argue the constitutional purpose of the census: counting citizens for congressional apportionment. Illegals are irrelevant.

Except the Constitution says exactly the opposite. The 14th Amendment uses the word "citizens" several times; but when it talks about apportioning seats in Congress, it says "counting the whole number of persons in each State."

It’s just a question about citizenship. Illegals can easily lie.

I think the Supreme Court or one of the Appeals Courts has already ruled that all residents illegal or not count toward representation in Congress.

If I’m wrong please let me know. I just remember reading a thread about this a while back.

I went back and found that the Supreme Court ruled in 2016 on the issue of drawing up Congressional Distircts.

Justice Ruth Bader Ginsburg, writing for the court, said even though only eligible voters are supposed to cast ballots, elected officials represent all people within their districts, and it is that act of representation, not the election itself, that the boundaries are drawn to.

So flood an area with illegals, count them, and get more clout in Congress. Sounds like California and Blue areas that have been importing illegals.

Flak is heaviest when over the target. Population means more electoral votes, more federal money. California will squeal the loudest if foreigners aren’t going to be counted.

We need a Conservative lawyer to sue to count persons in Eastern Europe & South Africa. Afterall, persons can be over a larger area.

Where are all the counter lawsuits?

Schneidermeyer and Becerra are the biggest state-level crybullies in the country. They both need a good butt whoopin to instill a little humanity.

How can they sue over restoring a question that was in the census before? Just pure crybullying.

Illegals have always been counted. The Constitution says to count population it is very clear in the 14th section 2.

This fight isn’t over who to count. It’s just a question that makes no difference in apportionment. In fact no one is obligated to answer any questions except enumerative ones.

The enumeration is ultimately meant to determine the number of representatives in a state, that’s why the original wording excluded indians from the count.

In the same manner, illegals and foreign nationals should not be counted. If you don’t vote, you don’t “count”.

If I were a legal immigrant, I would
be very proud to answer the question.
The left’s argument is even those
that had the fortitude to become
legal, would be afraid to turn in
their census forms. It is a baseless
argument, and exposes the left’s very
intent. The one question that is just
plain stupid, “how many toilets do you
have?” What the heck does that have to
do with a census count? When growing up,
there were 9 of us that fought for bathroom
rights. (We only had one).
Whites are privileged because they
have an average of 2-1/2 while
minorities only have one?
