Petition To Grant Three Goshen Elephants Legal Rights As 'Persons' Denied

The petition to grant three Goshen elephants legal rights as “persons” was denied by a judge at Superior Court in Torrington on Tuesday, court records show.

In a memorandum of decision, Judge James Bentivegna called the petition “wholly frivolous on its face in legal terms.”

The Nonhuman Rights Project (NhRP) had filed the lawsuit on Nov. 13, arguing that Beulah, Karen and Minnie — three elephants captured in the wild and now living at the Commerford Zoo in Goshen — are legal “persons” with fundamental rights and they must be released into a sanctuary.

“‘Person’ is not a synonym for ‘human being,’ but designates an entity with the capacity for legal rights,” the lawsuit claimed.

Bentivegna also wrote that the court lacked jurisdiction.

The NhRP argued that elephants “have a sense of self, remember the past and plan for the future, engage in complex communication, show empathy, and mourn their dead.”

If that's the standard, I'd say many CA residents don't qualify.

Please, it always helps to give the geographic location when it is not obvious. In this case, the Goshen referred to is in Hartford, Connecticut, not in the Middle East or Africa.

What part of the world did this take place?

The left is insane.

With rights there are obligations. If the elephants get rights they will have duties.

The left is insane.

For the sake of full accuracy, Goshen is not in Hartford. It is a town in Western Connecticut near Torrington.

If Hobbits have no rights neither can Oliphants and Orcs.

Agreed but in this case does it really make a difference: Hartford, Connecticut, the Middle East, or Africa?

Clearly, someone watched “Ted 2” while getting high and decided to give it a try in real life.

“‘Person’ is not a synonym for ‘human being,’...

But, but whose to say these elephants don't identify as human?

Surely, there is a large language barrier, but the NhRP could ask them how they identify - 1 stampy for human, 2 stampy for elephant, 3 stampy...

I like elephants, but I don't think the Republican Party should use the elephant as a mascot anymore.

Elephants never forget, but Republicans forget all of their campaign promises within minutes of landing in D.C.

“‘Person’ is not a synonym for ‘human being,’ but designates an entity with the capacity for legal rights,” the lawsuit claimed.

But... but... "Marriage" is not a synonym for 'one male and one female', but designates a gay couple with a desire to usurp 5,000 years of Judeo-Christian culture," Obergefell claimed.

Successfully.
