Federal grand jury indicts Kate Steinle shooting suspect
ABC News ^ | December 5, 2017

Jose Ines Garcia Zarate was found not guilty of murder in the death of San Francisco woman Kate Steinle, but a grand jury has other plans for the controversial defendant, indicting him on new charges. In a press release, officials revealed that a federal grand jury indicted Garcia Zarate Tuesday afternoon on being a felon in possession of a firearm and ammunition, and for being an illegally present alien in possession of a firearm and ammunition.

Officials said the indictment "merely alleges that a crime has been committed and Garcia-Zarate, like all defendants, is presumed innocent until proven guilty beyond a reasonable doubt."

I wonder if the Mayor of SF can be charged as an accessory to murder.

Question? Is he still in custody? Or has the State of CA released him?

Let’s hope there is a really TOUGH sentence guideline for these counts.

Where will the jury come from though?”

According to something Sessions said right after the verdict in SF, that an arrest warrant had been issued in Western Texas for him. So I am betting that they Grand Jury is in Texas, and that’s where he will be tried.

felon in possession of a firearm and ammunition, and for being an illegally present alien in possession of a firearm and ammunition.

Nothing about killing an American?

I guess they just plan on giving him some federal crime rather than justice for murder.

Better than nothing, I guess, but I'm not satisfied.

It would be a 10 year max on each count. He’ll probably end up pleading to one count and they’ll dismiss the other two. His guidelines will depend on his criminal history.

I think the SF not guilty verdict was a perversion of justice. But I still don’t like that the FEDS are getting a second bite at the apple. Remember the Rodney King trial?

In this case, the criminal alien was free because ICE asked for him to be detained but did not present a warrant. If they had presented a warrant, the SF Sheriff would have no choice.

Why doesn’t the Fed Govt set up an Administrative Court to just handle these warrants? A 24/7 court so that ICE can get a warrant on a moment’s notice? Local law enforcement cannot ignore a Federal warrant without consequences. After one or two local law enforcement or elected officials are brought up on charges, the momentum would shift in the fight to save our country. MAGA!

Wouldn’t a murder charge be double jeopardy?

They tried him, jury found him not guilty. On all charges except convicted felon illegal alien in possession of a firearm. He said he found it under a bench. Some how, I don’t believe him.

Reason they did not convict him? They said he did not intend to shoot her. The defense said the bullet hit the concrete on the pier and ricocheted and hit her through the back into her heart, killing her. (It was said he aimed it at a group of people and the gun went off, not a credible explanation. 10 lb trigger pull.)

Also remember, this is CA.

I have no idea. As many as needed? Its an idea to fix a problem. I don’t even know if it is feasible. I just want a solution to this problem. I welcome any and all solutions.
