Don’t know about this mass shooter, but most can pass the background check. Adam Lanza could legally buy a rifle, but not a handgun due to his age. The Columbine shooters were to young and used a straw buyer instead.
No aboveboard licensed firearms dealer is knowingly going to sell a weapon to someone who does not pass an NCIS check with a possible exception in the case of a delay as noted below.
An FFL license is too valuable and too difficult to obtain to risk on such a foolish act.
And the potential penalties for doing so are severe.
If the FFL dealer correctly fills out and submits the ATF Form 4473 and the background check comes back approved the gun dealer normally would have no obligation or justification to refuse a sale.
If the government response is delayed three business days with no decision the FFL dealer may, but is not required to, make the sale.

A Dishonorable Discharge would indeed have been the equivalent of a felony, but a Bad Conduct Discharge only equates to a misdemeanor.
