The judge who originally charged Sheriff Arpaio with contempt of court was U.S. District Court Judge G. Murray Snow, appointed by George W. Bush. Snow referred the contempt case to Bolton to rule on civil or criminal contempt.

The idea is supposed to be that laws in conflict with the constitution are not valid...in fact, they are "unconstitutional." The courts are supposed to reject any such laws.
Of course nowadays courts do whatever they want no matter how much they have to bend logic and common sense. Case in point: Supreme Court's approval of Obamacare.
