Byron York: The law already allows Donald Trump to build the wall

There's no shortage of people telling Donald Trump he can't build a wall on the U.S.-Mexico border. And maybe, in the end, he won't do it. But at the moment Trump takes office, he will have the legal authority and the money he needs to get started on the wall. Yes, there will be obstacles — what's the over/under on the number of lawsuits that will be filed trying to stop it? — but the fact is, the law is already in place that will allow Trump to go forward.

As in other areas of immigration enforcement, Trump will be able to effect radical change simply by following the law. In this case, it is the Secure Fence Act, passed in 2006 with bipartisan support — 283 votes in the House and 80 in the Senate, including then-Sens. Barack Obama and Hillary Clinton.

Finding a way to divert funds to construct the wall is the avenue Trump should take. He shouldn’t fall into the trap of shutting the government down.

“For funding, Trump could ask Congress to fund wall construction through the regular appropriations process. Or he could ask Congress to re-program billions of dollars that the Obama administration intended for other purposes. Or he could look for money elsewhere in DHS.

“There are funds provided annually to the Department of Homeland Security for construction in the Procurement, Construction, and Improvements Account that could be drawn on to begin construction along the border (perhaps with the need for some re-programming),” noted a senior Republican aide on Capitol Hill.

In addition, Trump could actually try to make Mexico pay for the wall, or at least for part of it. Trump’s plan to do so — a fee on remittances and a fee on visas, which together Trump claimed might raise at least $5 billion — is actually one of the more detailed proposals released during the campaign.

Trump’s final problem, and perhaps the most serious, will be litigation.

In a related issue about executive orders; why not skip the EOs and just enforce the law. The executive orders only give the crazed Leftist judges a point of focus to attack.

Wasn’t $700million already allocated?

You could put a nice fence (for starters) for that amount.

Patrol it carefully and you don’t need an actual brick wall.

Why would Trump shut down the government?

The democrats are the ones threatening to filibuster the CR and shut down the government over the wall. So your solution is to surrender to their blackmail? Let them shut it down.

Oh yeah? Like what?

President Trump might be stuck with a couple of squishy RINO senators, like Murkowski, Collins, Gardiner, Flake and another, but he can put them in line.

The real question is about funding. But - Donald Trump has always said he will get Mexico to pay for it. And now that Ted Cruz has come up with the El Chapo plan; I don’t get what all the latest panty wadding in the press is all about.

Except to say the goal of the media has always been to stir up trouble and agitate.

YES! YES! YES! Definitely, need a concrete or brick wall.

30 feet high, at least 12 feet deep into the earth.

I’ve seen drawings of some of the ideas submitted. They’re beyond excellent. High tech.

Can barely wait to see the models constructed here on San Diego’s border.

Seems like there was, I’ll have to research and see if I can find it...the money is there...we just need to take it and do it...

President Trump is showing us another ‘drawn curtain’ with the Congress, I’m sitting back watching what happens...we know about RINO RYAN and McTurtle, now we need to find out the rest of them...then we will know who to primary out in 2018...

This is the way President Trump operates...right from the beginning...many, many curtains have been drawn open for us to see, the candidates, the super pacs, the lobbyists, the GOPe, the world stage, yeah we are going to know the whole thing in about 3 more months...

Because he'll take a beating in the polls and it won't work.

Dems, RINOS in the Senate and media will pile on him. That WANT a government shutdown.

When vacationing families can go to see the sites in DC or national parks, it will be disaster for Trump and cost him votes in 2020.
