Obama spying on Trump needs investigating
Washington Times ^ | March 15, 2017 | Andrew P. Napolitano

Posted on 03/16/2017 8:20:37 PM PDT by TBP

Mr. Obama would not have needed a warrant to authorize surveillance on Mr. Trump. Mr. Obama was the president and as such enjoyed authority under the Foreign Intelligence Surveillance Act (FISA) to order surveillance on any person in America, without suspicion, probable cause or a warrant.

Thus, in 2016, when Mr. Trump says the surveillance of him took place, Mr. Obama needed only to ask the NSA for a transcript of Mr. Trump’s telephone conversations to be prepared from the digital versions that the NSA already possessed. Because the NSA has the digital version of every telephone call made to, from and within the U.S. since 2005, if Mr. Obama last year wanted transcripts of Mr. Trump’s calls made at any time, the NSA would have been duty-bound to provide them, just as it would be required to provide transcripts of Mr. Obama’s calls today if Mr. Trump wanted them.

I hope the investigations of Mr. Trump’s allegation discover and reveal the truth — whatever it is. But the lesson here is terribly serious. We face the gravest threat to personal liberty since the Alien and Sedition Acts of 1798 proscribed criticism of the government. We have an unelected, unnamed, unaccountable elite group in the intelligence community manipulating the president at will and possessing intimate, detailed knowledge about all of us that it can reveal. We have statutes that have given the president unconstitutional powers that have apparently been used. And we have judges on secret courts facilitating all this as if the Constitution didn’t exist.

For how much longer will we have freedom?

Pres. Trump has not convinced many people that this actually happened. To add another category of speculation seems unproductive. Maybe he’s stringing this out for an as yet unknown reason.

Sort of.

The NSA is capturing all data going across certain networks. The specifics aren’t fully know but suffice it to say, IP data, and any data crossing the border is being collected wholesale.

“(no wonder there is little evidence for President Trump to produce)”

What do you know, or not know, of what Trump has available to produce? Are you in his inner circle?

Trump has had, and maintains to this day, his own security personnel and apparatus.

Does he do that because he’s a fool and likes to waste his own money on duplication of efforts.

Use your head man! Trump did not make these claims because he wanted a media circus. He lets politicians know what he wants them to know when he wants them to know it. Then he sits back while they speak publicly about it, in front of a camera. Then, and only then, he hands them their testicles on a sliver flat-screen platter.

Trust me, Trump learned that he was being spied on real-time because he pays people to lock his information down, and not with a two-bit lock. And by the way, he pays them bigly.

I would suggest to you, Trump’s security approached him and said, “sir, you’re being hacked and tracked starting at this point.”

And there was no doubt a Secret Service agent standing right there when he was informed. Do you remember those stories about the friction between Trump’s private security and the Secret Service?

Huh.

MSM is gushing that the Senate and House Intelligence Committees completed their investigations have come up with nothing! The investigations are completed after, what, a little over a week? That is a world record. Both the Senate and House completed all discovery, cross examining of witnesses, analyses, etc in a little over a week? Really?

FYI, I hear the Intelligence Community has a bridge up for sale and MSM is buying it and then trying to sell it to us.

In particular this passage (hopefully this is not true):

Amazon holds a $600 million dollar contract with the CIA, and all 16 other intelligence agencies for all of their cloud hosting. This is helping all agencies share information, so breakdowns don't happen that would potentially allow another 9/11 level event take place.

I don’t think Napolitano’s characterization of Presidential discretion under FISA wrt “United States persons” is accurate.

https://www.law.cornell.edu/uscode/text/50/chapter-36/subchapter-I

I am not a lawyer but as I read Section 1802, surveillance ordered by a President w/o a court order only applies to foreign entities and persons.

“United States persons” are specifically excluded.

And in any case, the Attorney-General has to also sign off on any such surveillance - and any FISA court application to wiretap US persons as well.

Which is why, in my view, Loretta Lynch’s deafening silence throughout this whole episode is notable. As is the lack of media interest in getting her on the record. (As Rush says, the drive-bys are scared of the answers, so they avoid the questions).

I’d like any Freepers who are actually lawyers to weigh in on this.

I am not exactly sure what you are talking about, but I am assuming that your seemingly snarky post (DOH! Pass me the popcorn) refers to the first sentence of the thread article...Good stuff except your post is not related to my one word comment addressed to another Freeper.

My “Wow” comment was related to fact that “Amazon holds a $600 million dollar contract with the CIA, and all 16 other intelligence agencies for all of their cloud hosting. This is helping all agencies share information, so breakdowns don’t happen that would potentially allow another 9/11 level event take place.”

That issue/fact has nothing to do with Presidential authority or Trump can do the same thing”

DOH! Pass ME the popcorn.

Pres. Trump has not convinced many people that this actually happened.

"Wiretapping" of then candidate and president-elect Trump was reported by The New York Times and other news outlets. When President Trump found out about it, he called attention to it. It is not up to him to prove or disprove what the media, itself, has reported. But he is the hated outsider -- hated, by the way, not only by the enormous array of Leftists in this country, but by many on the Right as well.

And so the vast insiders club that feeds at our government trough considers President Trump a threat simply because he is a Right-wing outsider wild card, and they will do everything possible to destroy him. They won't speak the truth or investigate fairly or support him in any way. They don't want to be convinced, don't you get it?

No evidence...

“For how much longer will we have freedom?”>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>

No evidence?

They’ll make sure there is no evidence:

Theory:

Feinstein and Grassly NOW know that Obama broke the sedition law, by arranging Trump surveillance through a foreign nation.

Strange reactions of Feinstein and Grassly:

http://www.freerepublic.com/focus/f-chat/3535471/posts

And their job is now to make sure that any evidence of Obama’s crime disaappears.

Trump will likely point the investigation to the British Security Service, and Feinstein and Grassly are likley refusing to let the Senate Investigation Committee go there.
Feinstein and Grassly already know that Obama broke the law, and now they are covering it up, with the likely help of a couple of RINO Republicans.

Meanwhile Obama is all alone in Bora Bora, all by himself, without the wookie. Passingly strange.Looks like he is ready to bolt as a fugitive.

Jeezo. I just don’t get this.

It is pretty apparent that there was surveillance going on. THAT is undeniable.

Makes no difference if they tapped into an analog phone line, sucked the data from an IP stream, inserted microphones somewhere, or whatever. The fact that conversations were monitored shouldn’t be in question, but there are still people out there saying it didn’t really happen.

I just don’t get that from some posters here, I thought that was pretty plain.

The question is by whom, and to what end.

First of two parts and maybe more on the 7+ decades long history of the UK’s spying on our people and us spying on their people.

UKUSA Agreement
From Wikipedia, the free encyclopedia

The UKUSA Community: Australia, Canada, New Zealand, the United Kingdom, and the United States

The United Kingdom – United States of America Agreement (UKUSA, /;/ew-koo-sah)[1][2] is a multilateral agreement for cooperation in signals intelligence between Australia, Canada, New Zealand, the United Kingdom, and the United States. The alliance of intelligence operations is also known as the Five Eyes.[3][4][5][6][7]

In classification markings this is abbreviated as FVEY, with the individual countries being abbreviated as AUS, CAN, NZL, GBR, and USA, respectively.[8]

Emerging from an informal agreement related to the 1941 Atlantic Charter, the secret treaty was renewed with the passage of the 1943 BRUSA Agreement, before being officially enacted on 5 March 1946 by the United Kingdom and the United States. In the following years, it was extended to encompass Canada, Australia, and New Zealand. Other countries, known as “third parties”, such as West Germany, the Philippines, and several Nordic countries also joined the UKUSA community.[9][10]

Much of the sharing of information is performed via the ultra-sensitive STONEGHOST network, which has been claimed to contain “some of the Western world’s most closely guarded secrets”.[11]

Besides laying down rules for intelligence sharing, the agreement formalized and cemented the “Special Relationship” between the UK and the USA.[12][13]

Due to its status as a secret treaty, its existence was not known to the Prime Minister of Australia until 1973,[14] and it was not disclosed to the public until 2005.

[13] On 25 June 2010, for the first time in history, the full text of the agreement was publicly released by the United Kingdom and the United States, and can now be viewed online.[9][15] Shortly after its release, the seven-page UKUSA Agreement was recognized by Time magazine as one of the Cold War’s most important documents, with immense historical significance.[13]
The global surveillance disclosure by Edward Snowden has shown that the intelligence-sharing activities between the First World allies of the Cold War are rapidly shifting into the digital realm of the Internet.[16][17][18]

Due to its status as a secret treaty, its existence was not known to the Prime Minister of Australia until 1973,[14] and it was not disclosed to the public until 2005.

Part two of ??? parts history of our agreement where the Brits spied on our people and we spied on their people for 7+ decades. Unlike PRISM, the MUSCULAR program requires no (FISA or other type of) warrants.

“It couldn’t possibly be true, because that is not how our system works,” Pelosi said during a Christian Science Monitor breakfast in Washington.

“We do not investigate, through a FISA court, Americans — here or abroad.”

Well, Nancy how about this: “Unlike PRISM, the MUSCULAR program requires no (FISA or other type of) warrants.”

MUSCULAR (surveillance program)
From Wikipedia, the free encyclopedia

MUSCULAR (DS-200B), located in the United Kingdom,[1] is the name of a surveillance programme jointly operated by Britain’s Government Communications Headquarters (GCHQ) and the U.S. National Security Agency (NSA) that was revealed by documents which were released by Edward Snowden and interviews with knowledgeable officials.[2] GCHQ is the primary operator of the program.[1]

GCHQ and the National Security Agency have secretly broken into the main communications links that connect the data centers of Yahoo! and Google.[3]Substantive information about the program was made public at the end of October 2013.

Contents:

1 Overview
2 Operational details
3 Reactions and countermeasures

7 External links

Overview:

The programme is jointly run by:
– Government Communications Headquarters (GCHQ) (United Kingdom)
– U.S. National Security Agency (NSA)

MUSCULAR is one of at least four other similar programs that rely on a trusted 2nd party, programs which together are known as WINDSTOP.

In a 30-day period from December 2012 to January 2013, MUSCULAR was responsible for collecting 181 million records. It was however dwarfed by another WINDSTOP program known (insofar) only by its code DS-300 and codename INCENSER, which collected over 14 billion records in the same period.[4]
Operational details:

According to the leaked document the NSA’s acquisitions directorate sends millions of records every day from internal Yahoo! and Google networks to data warehouses at the agency’s headquarters at Fort Meade, Maryland.

The programme operates via an access point known as DS-200B, which is outside the United States, and it relies on an unnamed telecommunications operator to provide secret access for the NSA and the GCHQ.[3]

According to the Washington Post, the MUSCULAR program collects more than twice as many data points (“selectors” in NSA jargon) compared to the better known PRISM.[2]

Unlike PRISM, the MUSCULAR program requires no (FISA or other type of) warrants.

Because of the huge amount of data involved, MUSCULAR has presented a special challenge to NSA’s Special Source Operations. For example, when Yahoo! decided to migrate a large amount of mailboxes between its data centers, the NSA’s PINWALE database (their primary analytical database for the Internet) was quickly overwhelmed with the data coming from MUSCULAR.[5]

Closely related programmes are called INCENSER and TURMOIL. TURMOIL, belonging to the NSA, is a system for processing the data collected from MUSCULAR.[1]

According to a post-it style note from the presentation, the exploitation relied on the fact that (at the time at least) data was transmitted unencrypted inside Google’s private cloud, with “Google Front End Servers” stripping and respectively adding back SSL from/to external connections.

According to the Washington Post: “Two engineers with close ties to Google exploded in profanity when they saw the drawing.” After the information about MUSCULAR was published by the press, Google announced that it was working on deploying encrypted communication between its datacenters.[2]

Federal Judge Who Blocked Trump Order Was Obama’s Classmate

Ever since a federal judge in Hawaii issued a sweeping freeze of President Donald Trump’s new immigration moratorium Wednesday, conspiracy theories have abounded across social media.

The leading theory suggested that former President Barack Obama played a role in the ruling. As noted by Hawaii News Now, the former president arrived in the islands Monday for an unexpected visit.

He reportedly dined Tuesday evening at Noi Thai Cuisine, an upscale restaurant, less than 24 hours before U.S. District Court Judge Derrick Watson, a law school classmate of Obama, ruled against Trump’s immigration order.

What concerned conspiracy theorists, according to the Infowars, was that the restaurant was “just minutes away from the courthouse” and that “Obama was likely within five minutes of the judge’s house at one point on the drive over.”

Plus, according to an old White House transcript, it was in fact Obama who had appointed Watson to the court three years ago.

And while Obama’s trip to Hawaii was ostensibly a vacation, PopSugar has reported that “he’s still making time to take care of business.”

“Given that Obama appointed the judge, graduated in the same year as him and visited Honolulu and was within minutes of the judge less than 48 hours before Judge Watson made a major ruling that blocked Trump’s travel ban, it doesn’t take a wild-eyed conspiracy theorist to insinuate that the two could have met,” Infowars concluded.

Was it a conspiracy or a coincidence? Most Americans would likely assume it was just a coincidence, but the existence of a confirmed Obama-operated “deep state” does make one wonder just how far he would be willing to go to thwart Trump.

In fact, according to Breitbart contributor Aaron Klein, Obama may very well “be seeking no less than Trump’s impeachment.”

Obama spying on Trump needs investigating

Ping to # 44. - Federal Judge Who Blocked Trump Order Was Obama’s Classmate

First, read # 44 ... then check out article , graphics .

..................

From # 29:

No evidence...

“For how much longer will we have freedom?”>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>

No evidence?

They’ll make sure there is no evidence:

Theory:

Feinstein and Grassly NOW know that Obama broke the sedition law, by arranging Trump surveillance through a foreign nation.

Strange reactions of Feinstein and Grassly:

http://www.freerepublic.com/focus/f-chat/3535471/posts

And their job is now to make sure that any evidence of Obama’s crime disappears.

Passingly strange. Looks like he is ready to bolt as a fugitive.

Thanks, Art.

Trump needs to go to War with Obama. Total complete surveillance of all his communications, his home, Valerie, all his old cronies. Past review of Obama's many offenses by Jeff Sessions to clarify and pursue the indictable offenses.

Plus, all his embeds that can't be removed in the state department, dept of justice and other bloated bureaucracies.

Plus, total surveillance and IRS, FBI investigation of Organizing for America, Organizing for Action and the various other Obama deep state organizations. RICO actions, whatever, to root out these domestic enemies.

Plus, put the crunch on Soros any way we can, surveillance, IRS, RICO, FBI, 'reasonable suspicion'. He has to quit attacking our country and funding all these leftist/communist organizations.

They've declared War on us and our President Trump, so we need Fight Back!

President Trump has a lot of work to do and a lot he wants to accomplish in the next eight years. These daily roadblocks need to stop. We need to put the kibosh on this Obama sedition/treason Now so President Trump can get his work done.

Go Trump! Go Sessions!

Obama runs away and the Germans are in Washington D.C. . .

Pray for President Trump and, even though the election is over, continue to prepare.

I was wondering about that, and hadn’t yet checked it out.

Absolutely...1000%...believable that Obola and ILLary (individually or jointly) would do it.Brazille just admitted that she gave ILLary debate questions beforehand.

I'm no expert on such matters but if spying did occur it will be damn hard to prove.
