Judge rules against tribes, clears way for Dakota Access pipeline to begin moving oil next week

A federal judge has denied a last-minute plea to stop the Dakota Access pipeline, allowing the $3.8 billion oil pipeline to begin operating as early as next week.

U.S. District Court Judge James A. Boasberg ruled Tuesday that the Cheyenne River Sioux and Standing Rock Sioux are unlikely to prevail on the merits of their challenge to his March 7 decision, saying that the court “believes that Plaintiff does not have a strong case on appeal.”

A status report filed Monday by Dakota Access LLC said oil is expected to start flowing through the North Dakota section of the 1,172-mile, four-state pipeline between March 20 and March 22, “depending upon the success of the testing.”

Another status report is expected to be filed with the court Monday.

The tribes had asked for a preliminary injunction to stop the pipeline on religious grounds, arguing that flowing oil underneath Lake Oahe would desecrate the water, which is sacred to the tribes, and fulfill the “black snake prophecy.”

That was more than just dump trucks. They said it was 850 roll off dumpsters. those hold 40 yards each. Two of them will fill up the average semi trailer, so these brave friends of the earth left behind almost 500 semi trailers full of trash. That’s almost enough to start their own landfill.

tribal elders know that the black snake prophecy can only be avoided if the tribe is given a cut of the oil pipeline transfer revenues. “A toll on oil saps black snake’s power” is ancient wisdom passed down through the ages at this most sacred site...

The black snake prophecy is a Lakota prophecy where some day a large black snake. will one day come and poison the land. (reminds you of a pipeline doesn't it?)

Curious, a few weeks ago I looked up Lakota religious beliefs at various places along the internet. Nowhere did I find a reference to a black snake prophecy that pre-dates this pipeline protest.

I was thinking of those really big quad axle dump trucks holding up to 30 tons or the really really big ones used in open pit mines which hold over 400 tons.

However, trucks haul by weight not yardage. So you cannot extrapolate from volume/roll-off to volume/semi unless you know the weight of each dumpster. Semis carry about 70,000 lbs which is 35 tons.

Since there was a lot of snow/water content the weigh of each roll-off would be more than ordinarily encountered.

If a roll off is too heavy (or over full), then the truck pulling it up will not be able and the roll-off will have to be lightened (manually)

Best not to think of the stuff they picked up as trash (newspapers, candy bar wrappers, plastic bags, etc) - but as very smelly garbage including rotting food and 5 gal buckets of human waste.

A different article defined the 40 yard roll offs but some people on the thread were envisioning 4-6 yard parking lot dumpsters. So I looked at cubit footage and made my comparison that way since everyone know what a semi trailer dry van looks like
