Sanctuary City Sets Illegal Immigrant Criminal Free — US Citizen Pays the Ultimate Price…

Roughly six months ago, Ever Valles was arrested by Denver police on charges of illegal possession of a weapon and vehicle theft. The suspect was reportedly flagged by Immigration and Customs Enforcement (ICE) as an “immigration enforcement priority," given his known gang affiliation.

A detainer request was put on Valles, asking the city of Denver, a so-called “sanctuary city” to notify them before he was released, so they could take him into custody. However, Denver released Valles December 20, and ICE claims they were not properly notified.

Almost two months later, tragedy struck.

On February 17, Valles was charged with first-degree murder for the death of 32-year-old Tim Cruz. A second suspect, Nathan Valdez, was also charged with murder. Both suspects were also reportedly charged with multiple counts of aggravated armed robbery and kidnapping.

Valles and Valdez are accused of robbing the victim at gunpoint before killing him at around 1 a.m. on Feb. 7. ICE described Valles as a “known gang member” and “citizen of Mexico.”

“Due to his criminal history and gang affiliation, Valles is an ICE immigration enforcement priority,” the agency said in a statement.

The Denver Sheriff Department claimed it alerted the local ICE office of Valles’ release at 11:33 p.m., on December 20, roughly a half-hour before Valles was released from jail. ICE, however, argued they didn’t receive any fax until about 38 minutes after Valles had already been set free.

“The detainer wasn’t honored,” ICE said in a statement. The issue of sanctuary cities has become a hot-button topic since President Donald Trump took office months ago.

In one of his first acts as president, Trump signed an executive order calling for an end to sanctuary cities. He has also threatened cut federal funding for sanctuary cities that refuse to cooperate with federal immigration authorities.

So Denver PD says they informed ICE a half hour before he was released...

I bet the Denver PD doesn’t respond to most calls in that amount of time!

A quick check on the phone records showing when the fax was sent would prove them as liars anyhow.

It also seems to me ANY L.E.O. releasing to the public any person that ICE has put a detainer on due to Immigration status can and should be held legally accountable for assisting in the furtherence of a crime.

I’ll betcha if we started prosecuting the mayors and all the city council members as accessories to these murders that the idea of sanctuary cities would disappear overnight.

Why didn't ICE get a warrant to hold him instead of merely requesting he be held?

Federal courts continue to rule that holding someone based on an ICE request, after they are otherwise free to go, is a Fourth Amendment violation.

The blame is with ICE. Get a warrant. A request is a request.
