Probably true, but in this case, the culprit was leaving.

Your Honor I believed that they were going to use the truck to run us over. This was my reasonable belief.

locally, a guy took one shot at his van being driven away by a crook in a robbery attempt....he was a good shot....

they brought charges up and the jury did the right thing and voted not guilty...
