Appeals Court Denies Justice Department's Motion to Lift Travel Ban Restraining Order By DEAN SCHABNER DAVID CAPLAN Feb 5, 2017 The U.S. Court of Appeals for the 9th Circuit announced early Sunday morning that it has denied the Department of Justice's emergency motion -- filed late Saturday -- to issue an immediate stay on a Washington State judge's temporary restraining order of President Donald Trump's controversial travel ban.

"The court has received appellants' emergency motion (Docket Entry No. 14)," read the order from the appeals court. "Appellants' request for an immediate administrative stay pending full consideration of the emergency motion for a stay pending appeal is denied."

Lawyers from Washington State and Minnesota, who brought the challenge to court in Seattle, have until Sunday at 11:59 p.m. Pacific Time to file a response to the Department of Justice's request. The Justice Department then has until Monday 3 p.m. Pacific Time to file a reply brief.

Lawyers for the Department of Justice argued in the filing that the restraining order is "vastly overboard," and it "second-guesses" the commander in chief.

So let me get this straight, is that two judges or one judge with four names, and that would be to get the treason charge correct. Both those, or that one, judicial appointee to keep things straight should immediately be charged with aiding and abetting the enemy that many have died fighting, as the order also aids a charge of national suicide aimed at the same member or members of the judiciary. Congress needs to step up and slap these folks upside the head while exercising national security.

...and no I didn’t follow the link, as I didn’t find it necessary under the circumstances. I’ll stand by for critique should it be necessary.

Surely this is not an unlikely event. Everyone knows about the 9th circuit and the Supremes. Never miss an opportunity to attack your enemies. The great speech at the Al Smith dinner is such a battle. The whole room had to sit there and listen. I loved it.

Very unsettling but not surprising. I suspect we are going to witness a historic battle between the judiciary, executive, and legislative branches.

I assume he’s condtructioist on national security

My understanding is that this judge has no jurisdiction because there are no plaintiffs harmed in his district by Trumps EO. The judges at the 9th circuit court of appeals are liberal and this could end up in the Supreme Court.

This isn’t a new ruling, it’s the same one that has been the subject of several recent FR posts. It is from the same Black Lives Matter supporter, Judge James Robart, who suffers from terminal White Guilt disease.

Agree.

The lower court (bad) ruling would stand. Wait a couple of weeks for the confirmation to take place and swearing in.

This actually can be used by Trump. Shows the importance of the Supreme court to be in place to ‘back the will of the people.’

Ginsberg is on her last leg. That’ll be a big fight when Trump replaces her with one of the 19 left from his list.
