Depends on what your idea of immunity is. He is the director of the FBI. He has to make a call as it is his responsibility to do so.
The problem I have with what he did is he is using a defense for her that can’t exist. There is no room in top secret level national security for mistakes. They may be made, but at the level she was working in there is no room for the aspect of “intent.” Accidentally or not, she put national security at risk by using an insecure source for her communications violating numerous OPSEC and COMSEC directives from any level. And when you consider Scooter Libby went to jail for after being prosecuted for mentioning to people at a party that Valerie Plame worked for the CIA. It didn’t make any idfference that she had an office there, went there every day, and her husband also worked there in another office, and everyone knew it, he was investigated for OPSEC violations. Hilary can compromise our entire security system and she gets “intent?”
But the kicker is that it was reported on a Limbaugh show that they had emails that were from her server instructing subordinates how to evade the scurity system by using patch and paste to erase security codes from sent emails. This reaches a new level of violations at it has now crossed over into espionage. An because it was done knowingly, it is now treason. Intent? Look in the air for pigs.
