Federal government to pursue criminal contempt charge against Maricopa County Sheriff Joe Arpaio

Prosecutors said Tuesday they will charge Sheriff Joe Arpaio with criminal contempt-of-court for defying a judge's orders to end his signature immigration patrols in Arizona, exposing the 84-year-old lawman to the possibility of jail time and clouding his political future as he seeks a seventh term.

The announcement in federal court sets in motion criminal proceedings against the sheriff less than a month before Election Day and comes as he has taken on a prominent role on the national political stage in 2016, appearing alongside Republican presidential nominee Donald Trump on several occasions.

Arpaio has acknowledged violating the order to stop the immigration patrols but insists his disobedience wasn't intentional.

The State of Arizona should be charged with allowing illegals to stay past their allotted visa times or Green Card allowances, this young woman is being led into the belief she and her family have been wronged. Sheriff Arpaio is doing what the laws compel him to legally do. Try this in Mexico....or Saudi Arabia ... Disobeying our laws and looking the other way is NOT compassion; it makes for pain and suffering. Sandra Day O'Connor is an Officer of The Law just like Sheriff Arpaio....profiling is a Politically Correct excuse to break the law....Ms. Hernandez it is the state of AZ. that let your family break the law....not the Sheriff.

This is a Political Hit, and has been from the start.

Sheriff Joe isn’t sophisticated enough to know the alphabet.

No reasonable prosecutor would take this case.

Sheriff Arpaio is being bushwhacked by Obama.

The Kenyan knows that this is his last chance to get Arpaio. The sheriff has the goods on Obama because of what the cold case posse found.

When Trump becomes president and reveals to the American public, the truth about Obamas past history, they are going to be shocked. This is why Obama is desperate to have Clinton succeed him. And Nancy Pelosi will be fleeing the country as well.

Before Obama leaves office, he will try to issue an executive order sealing his personal records for the next 100 years. Trump will immediately unseal them for all to see.

FR: Never Accept the Premise of Your Opponent’s Argument

Patriots, please bear in mind that the first thing that citizens need to get into the habit of doing with respect to any action of the feds is to check whether on not the states have delegated to the feds, expressly via the Constitution, the specific power to reasonably justify the action in the first place, the Constitution’s Section 8 of Article I the best place to start looking.

If there is no clear, express delegations of a specific power to the feds, the power to regulate immigration in this example, then such power is prohibited to the feds as evidenced by the following excerpt.

”From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added].” —United States v. Butler, 1936.

And in this example concerning Sheriff Arpaio, it is disturbing that regardless of politically correct interpretations of the Constitution’s “Uniform Rule of Naturalization” Clause (1.8.4) that are used to justify federal immigration laws, it remains that Thomas Jefferson and James Madison, Madison generally regarded as the father of the Constitution, had written, in terms of the 10th Amenndment nontheless, that the Founding States had not expressly constitutionally delegated the specific power to regulate immigration to the feds.

First, from the writings of Jefferson …

“4. _Resolved_, That alien friends are under the jurisdiction and protection of the laws of the State wherein they are: that no power over them has been delegated to the United States, nor prohibited to the individual States, distinct from their power over citizens. And it being true as a general principle, and one of the amendments to the Constitution having also declared, that “the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people,” the act of the Congress of the United States, passed on the — day of July, 1798, intituled “An Act concerning aliens,” which assumes powers over alien friends, not delegated by the Constitution, is not law, but is altogether void, and of no force [emphasis added].” —Thomas Jefferson, Draft of the Kentucky Resolutions - October 1798.

And here is the related excerpt from the writings of James Madison in Virginia Resolutions.

"That the General Assembly doth particularly protest against the palpable and alarming infractions of the Constitution, in the two late cases of the "Alien and Sedition Acts" passed at the last session of Congress; the first of which exercises a power no where delegated to the federal government, ...

… the General Assembly doth solemenly appeal to the like dispositions of the other states, in confidence that they will concur with this commonwealth in declaring, as it does hereby declare, that the acts aforesaid, are unconstitutional; and that the necessary and proper measures will be taken by each, for co-operating with this state, in maintaining the Authorities, Rights, and Liberties, referred to the States respectively, or to the people [emphasis added]. ”— James Madison, Draft of the Virginia Resolutions - December 1798.

In fact, using unconstitutional federal immigration laws as an example, note that Jefferson and Madison had also warned patriots to be on their guard against small encroachments of state powers by the feds.

i think that Trump is probably already aware that he has his work cut out for him with respect to politically “forcing” the unconstitutionally big federal government back into its Section 8-limited power cage.
