States that refuse to help resettle Syrian refugees are guilty of illegal discrimination, a federal appeals court ruled Monday, delivering a judicial rebuke to GOP vice presidential nominee Mike Pence, who as Indianas governor had tried to halt Syrian resettlement.
Judge Richard Posner, writing for the three-judge panel of the U.S. Court of Appeals for the Seventh Circuit, said theres no evidence that Syrians are more dangerous, and he said even if they are, allowing Indiana to refuse to resettle them would only foist the problem onto neighboring states.
Federal law does not allow a governor to deport to other states immigrants he deems dangerous, Judge Posner wrote, saying the governor should instead report his fears to federal bureaucrats for redress.

Why despite any misgivings I may have about him, there is no alternative but to vote for Trump. This must end.
Posner’s name keeps being floated as a future Dem nominee for SCOTUS.
Just something for you NeverTrumpers to think about.
POS is appropriate for the first three letters of his last name.
I’ll remember that Congress did nothing to thwart any of this.
Q: What do you call a lawyer with an IQ of 50?
A: Your Honor.
Some state should declare itself a “sanctuary state” and tell the feds they aren’t going to enforce or comply with any federal regulations at all. Then we could all have place to migrate to.
This is where you just ignore them...
Posner is an anarchist. He detests Christians and will roll over and play dead for any strong man who comes along.
His name used to be linked with Scalia and Bork. He ain’t no Scalia or Bork. Just a tool ...
The court does not get the final word...the people do. Lets fight back!
Your post is correct but needs additional discussion.
If residents of states believe that these Syrians are a clear and present danger that would be a basis for a break-up of the Union.
This is serious stuff...
I plan to.....Nov. 8, 2016
They also delivered a rebuke to millions of ordinary Americans who are alarmed by being forced to live alongside potentially unlimited numbers of Muslims who will not assimilate and who are instructed by their holy book to kill anyone who doesn't accept their religion.
Time to tell the courts to shove it!
INSANITY, TREASON, YOU NAME IT ...
If the congress voted not to allow syrian
"refugees"INVADERS into the Country, yet the Dictator in Chief went ahead, what authority does this "judge" have to force states to comply?
It would be different if the individuals were not bound by allah and sharia to take their constitution and install it wherever they go.
These “refugees” are enemy combatants here with one thing in mind, to replace the American constitution with that of islam.
They are an occupying invasive enemy force.
Nothing more than enemies of the state.
This certainly will press for a “political answer.” Maybe Posner just did Pence a great political favor.
Reagan Judge.. 1981.. Yale and Harvard grad..
Another East Coast, Ivy Leagued SHJ
Looking to build his “legacy” with the media
Did Congress vote to outlaw this? Haven’t followed much, or expected much.
f the courts
I would expect this from the 9th circus, but the 7th?
I’m going to go out on a limb and guess this judge has no family living in Brentwood, New York.
Just how much brutality will the American people put up with before their blunders are removed through personal tragedy?
If the law doesn’t apply to hilary, it shouldn’t apply to the states either.
It's illegal to not accept ILLEAGALY processed immigrants?
Reagan made some BAD judicial appointments.
Sandra Day O’Connor was a doozy.
Mark Levin was in on some of the vetting. He says these people just came in and flat-out lied to them.
Pence might do well to do this anyhow and force a facedown. The Constitution promises the states protection from “invasion” — and the claim that this stream of refugees is no more dangerous than any others is ludicrous or else Pence has the worst lawyers in the USA.
Again, the feds pushing everyone around.
Patriots are reminded that the only race-related right that the states have amended the Constitution to expressly protect deals with voting rights as evidenced by the 15th Amendment, that amendment giving the feds the specific power to strengthen only race-related rights that deal with voting issues.
And since the race-related issue that the court is addressing is clearly outside the scope of voting rights, the politically correct federal court does not know what it is talking about imo.
It certainly is serious stuff, especially when our government is currently infiltrated with radical muslim sympathizers, from the very top down.
The claim that there is “no evidence” that these are any worse than others, sounds just crazy. Does Pence have lousy lawyers? Could FR scout this data for him?
Bullcrap. There is no requirement that the country take in immigrants.
Much less that we bring them here ourselves.
That’s the key. These are foreigners brought to our country by our own government.
Same faggot judge who redefined marriage on the fly.
I thought they voted several months back to block further syrian refugees, but of course Paul Ryno and Mitch “0bama’s Bitch” could’ve backed off when their master showed his displeasure.
And so is POSner and his ilk.
‘Maybe Posner just did Pence a great political favor.’
I think His Honor just gave their campaign some prime ammo.
You nailed that, right on the head.
Postpone their release in Ellis Island Style internment camps until after the election. Make public threats to divert Welfare money to accommodate Obama’s Federal mandate. Use eminent domain to seize Federal Buildings and wildlife refuges for the facility. Watch the judge loose his libtard mind.
Posner is basing his decision on evidence. What evidence would that be? Americans blown to bits? Americans shot in a mall? That kind of evidence, your Honor?
That reminds of a joke.
What do you call a lawyer with an IQ of 50?
Why does anyone expect the rule of law to obtain in this country? There is more than adequate proof that we live under dictatorship.
It would also seem that there should be a coalition of governors here. Why just Pence?
If that’s what Posner really, truly wants then it would seem that FR itself would be about the best evidence scout there could be.
Jim Rob ought to shout out to Pence. This deserves at least the old college try.
