In August, the families of Sean Smith and Tyrone Woods, two of the victims in the Benghazi attack, filed a wrongful death lawsuit against Hillary Clinton. They alleged that Clinton was personally liable in their deaths. They also sued Clinton for defamation, negligence, and for intentional infliction of emotional distress. Well, it should come to no ones surprise that Hillary straight up ignored this lawsuit, with aides refusing to accept the court summons. You can read the lawsuit here. Now, something has to be done on their end to avoid having a judge rule automatically in favor of the families of Woods and Smith Katie Bo Williams of The Hill has more:
The Democratic presidential nominee was declared in default by the court clerk Friday — a designation that simply means she was served with court documents and that she did not answer the complaint. It is not a finding of liability.
In fact, Clintons Secret Service delegation and campaign aides refused to accept the summons, according to court documents.
But Clinton will now have to respond in some way — such as arguing that the default be set aside or moving to dismiss the case entirely — to avoid the possibility that a judge could rule automatically in favor of the plaintiffs.
Her lawyers could also seek an extension that would push her deadline for response past the November election.
Patricia Smith and Charles Woods claim in the suit that the attack that killed their sons, Sean Smith and Tyrone Woods, as well as two other Americans, was directly and proximately caused, at a minimum by Clintons use of a private email server while in office.

Fridays declaration of default doesnt carry any automatic impact — a default judgment, for example, would require a request from the plaintiffs. The court now awaits motion from either party.
Yet, for now, we have a House Oversight Committee hearing today, where one of the men, Bryan Pagliano, who helped set up Hillarys unauthorized and unsecure email server refused to testify, while the Platte River Networks who used Bleachbit to wipe her server clean plead the fifth
It might as well be. They need to get a judgment after default and prove up damages.
To respond would set her up for perjury and possible criminal prosecution
I hope the jury or Judge awards the families a default judgment that drains the Clintons of hundreds of millions of dollars
Why would she had to have accepted the summons? Laws to not apply to her, do they?
Clinton and her aids refused accepting service? Then, serve by publication. That would be a fun news story.
Awesome!
People who are sued can simply REFUSE THE SUMMONS..!
Then they owe NOTHING..!!
She’ll rely on her poor health to skate.
Ben Gahzi was an Obama globalism redistribution program. For them it is not a question of if and when we get our ambassadors hanged, but how.
This suit could make the case that the how he was hanged and left alone was entirely unfair. It sounds inane and silly but this is what feminine liberals like to argue and feel most for in juries.
Arkancide for the court clerk and judge?
They should sue Bryan Pagliano in their suit. He may have immunity from criminal prosecution but a good civil judgement could hit him where it hurts.
Throw in a toaster, a Maytag washer & a dozen long stemmed roses, as in, your political career is now TOAST, take your Maytag & CLEAN UP YOUR ACT...
The roses? Let's just say that we a overjoyed to see you leave!
..........a few more steps before that. One is a “motion to set aside” any such judgment and likely until after the election. Depends on the judge.
In any event, not much can happen in our decrepid court system until after the election. Even then it could go on for years. Clintons have the money. They will pay them a few million to get lost, at some point. Case will be sealed and no one will be able to talk about it.
