The degree to which the margin of error is meaningful is the degree to which the sampling methodology is random. ±3% is only valid from a sampling of people who have already voted, and honestly reported how they voted.

All pre-election polls assume that their modeling or corrections formulas will be accurate predictors of whether or not a sampled individual will indeed vote. That is why polls of adults mean nothing, polls of registered voters mean only slightly more than nothing, and polls of likely voters are only as good as the likelihood model.

Also: A poll in which respondents indicate they voted for 0bama at a 52% rate and Romney at 41% has a sampling methodology issue and is not random.
