Presumably, when Posner took office, he had to take an oath to defend the Constitution:
I … do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as … under the Constitution and laws of the United States. So a bunch of unimaginative dolts wrote the founding documents and debated all manner of things they wanted to guard against in the future based on their past, but it is irrelevant because they just couldn’t presume every single nightmare of tyranny?
I think they had a solid idea and a solid concept of all that entails and were intentionally strict about what the fed gov had control over and what the people and the states had control over. The whole idea was that the people through their representatives would enact just laws and those reps would stay within their constitutionally allowed powers. The people are at fault for letting the fox guard the hen house and letting things get this far.
Face it, we were infiltrated back in the 30s/40s and it has been downhill ever since.

Follow-up question #2: Many years ago my state entered this union with the Constitution as its governing authority. Why should that state continue to remain part of the union?
