Great ruling! Too bad it is only from a 3-judge panel (and Judge Diarmuid O’Scannlain is a Reagan appointee who will soon be 80, so he won’t be there for long...hopefully Trump will replace him, not Shrillary). This is certain to go before the entire Court en banc, but at least we have this to go on for a while.

In the last few years, the Ninth Circuit Court has handed down a few really decent decisions. Not sure what to make of it, but at least they are getting a few decisions right these days.

From the article it said the regulation effectively banned all gun stores from the county. Perhaps it was just too obvious.

This isn’t unheard of in the Ninth Circus. Though I can’t remember specific cases, some have been decided against the larger court’s grain by 2-1 counts. The usual move for the bad guys is to now request a hearing before the full 28 (or so) member court. Usually those straighten out the “misunderstanding.”

The court itself hasn’t changed it’s rattles; it just messes up now and then and puts two conservatives into the three-judge panel. Remember, this is California and the judges are from San Francisco.

Perhaps the county, given that guns are portable, could not articulate what the 500 foot barrier was trying to accomplish, and what government safety interest was being served that would overide a strict scrutiny interpretation.

IMHO one of the worst aspects of the liberals War On Guns is that for many young people they have destroyed the experience of owning a gun, learning the safety rules, how to shoot it and take care of it, how to plink and hunt, etc.

They have also taken away the sense of comfort, self reliance and independence an experienced gun owner has around guns and in doing so have turned much of the US population into GFW’s.

In pre and post WWII America young boys owning and carrying guns (and pocket knives) was the norm.

High schools had gun clubs, shooting competitions and outside of the large cities it was perfectly normal to see a couple of youngsters walking along the road with their .22 rifles or maybe out in a field plinking crows or at the dump shooting rats.

But many young people today grow up with a lack of familiarity with guns, shooting, carrying a pocket knife or whittling a big stick into a small one.

But that is exactly how the liberals want it.
