EPA Administrator: ‘We Rock’ at Writing Rules

Environmental Protection Agency (EPA) Administrator Gina McCarthy said Friday that the EPA is very good at making rules requiring individuals, businesses and state and local governments to comply with laws related to “protecting” the environment.

“If anybody knows anything about EPA and writing rules--we rock at it,” McCarthy said at the Climate Action 2016 summit held last week in Washington, D.C. "We do them legally. We do them on the basis of sound science. And while there is a pause, there’s no pause in the action in the United States towards renewable energy and energy efficiency. We are going in exactly the direction our rule demanded and we’re doing it because the market’s demanding it.

“We could not be in better shape then we are today,” she said.

McCarthy also said her agency is moving forward on the Clean Energy Incentive Program – part of the Clean Power Plan -- to encourage investment in wind and solar energy.

McCarthy told Bill Nye, who interviewed her, that she had no doubt that the United States would “live up” to its obligation under the United Nation’s climate change agreement the Obama administration signed onto in December in Paris.

The woman’s a complete idiot, a shrill partisan, and living proof that the entire Code of Federal Regulations should be thrown out as Un-Constitutional lawmaking by bureaucrats.

Real environmental abuses can be handled as public nuisance torts, not by thousands of annual regulations.

Congress passed the laws that the EPA is enforcing. If the EPA had not been created by Nixon’s executive order, there would be four or five mini-EPAs at Commerce, Interior, Labor, Agriculture, and Justice trying to enforce Congress’s absurd “environmental “ laws.

Well, suits could be brought according to the laws, but the EPA is completely out of control. They are practically an environmental religious police.

Your point is valid, though. My next recommendation would be the sunsetting of most laws, unless reviewed and renewed, or explicitly decreed as of indefinite life on passage... which should take a super-majority.

And, while I’m in the mood, I’d also like to see “truth in legislative packaging,” so that laws contain clauses only germane to the title, and riders are forbidden.

You can cut a tree down but if you really, really want to kill it you must dig it up by the roots!

Translated: The EPA needs to be RETROACTIVELY killed all the way back to it’s first HOUR of existence. This means a lifetime Special Prosecutor appointed to ferret out criminal activity and prosecute.

You are correct about the laws being awful.... but it is also true that the EPA and other agencies create 1000s of regulations which have not been given adequate oversight by congress... who refuses to do so. At least with laws there is some kind of recourse, but with regulations the options of recourse are limited.

The EPA has morphed into an enemy of the republic. They need to be destroyed, not disbanded. After which, their employees should be banned from all future gov’t or municipal employment.

A letter to your senators and representatives:

Dear _______________, it has become increasingly obvious that the president intends to use the power of the MANY governmental agencies to bypass the will of the people and Congress. For that reason, it is imperative for Congress to reclaim the power it has abdicated to the executive branch. I propose a simple amendment that be put in EVERY bill voted on by Congress until it passes. The wording is as similar to the following:

“No government agency, organization, or entity created by Congress in the past or future shall have legislative or judicial powers. For the purpose of this amendment, “legislative power” shall be construed to mean the making of any rule violation of which renders a citizen, legal entity, corporation, or company of any state or the United States to imprisonment, fine, excessive or punitive fee, or other punishment. “Judicial power” shall be construed to mean, the holding of any evidentiary hearing not presided over by an Article III court or the issuance of findings which result in imprisonment, fine, or punishment of a citizen, legal entity, corporation, or company of any state or the United States.

Under this law, all current rules implemented by any government agency, organization, or entity created by Congress that has legislative or judiciary powers as defined above will become null and void five years from the date of passage unless approved by normal constitutional means.”
