Even being convicted of homicide isnt enough to ensure illegal immigrants are detained by federal agents, the governments top deportation official said in a letter to Congress released Monday.
U.S. Immigration and Customs Enforcement Director Sarah Saldana said neither Obama administration policy nor federal law required her agency to detain Edwin Mejia, an illegal immigrant who arrived as part of the surge of unaccompanied children from Central America, after he was charged with vehicular homicide in Nebraska.
Still, she said her officers should have taken the initiative to detain him of their own volition, and she said shes notified all of her bureaus nationwide to do a better job of evaluating people theyre called to detain.
Mr. Mejia stands accused of a drunken-driving accident earlier this year that killed a young Iowa woman in Omaha but federal immigration agents never showed up to collect him, and after he posted bond with local authorities he absconded.
After further review, we believe that further enforcement action would have served an important federal interest in this case, Ms. Saldana said in a letter to Sen. Ben Sasse, Nebraska Republican, which the senator released Monday.
ICE said it first encountered Mr. Mejia, who also goes by the first name Eswin, at the border in Arizona in May 2013. He was a 16-year-old at the time, and the Border Patrol, acting under President Obamas interpretation of the law, admitted him and shipped him to social services, then eventually sent him to live with his brother here in the U.S. Ms. Saldana did not say whether the brother was in the U.S. legally.

Am not familiar with Nebraska but this was Omaha, big enough to know better.
I assume this depended on Omaha having told the Feds about the homicide. I live in that city presently. On the main it seems pretty competent but this is a major screw up. Forget telling the Feds! Tell YOURSELF about it!

If you run them over with a vehicle, you won't have to deport them. Apparently, it isn't a crime if they do it, so why would the converse be a problem?
Precisely. The equal protection clause of the 14th Amendment cuts both ways. It's not like the 14th isn't already being abused to the disadvantage of US citizens.

Saldana and Rodrigues' federal agencies then "invent" happy-sounding Committees to handle it. "Administrative Rules," after a comment period, are then published in the "Code of Federal Regulations," which magically turns them into law........ using federal fairy dust.
Now Obamba is shielded from responsibility---he doesn't have to take the hit. Behind closed doors, he tells Saldana and Rodrigues what he wants.....and faster than you can say "the combo plate w/ extra hot sauce".....the overthrow of the US govt commences.

THE "DELEGATION" HORROR STORY--A Federal agency MO since 1946. It's down to a science: (1) publish a Notice of Proposed Rulemaking (NPRM), (2) make the comment period really short, (3) stonewall any negative comments, and, (4) publish the rule, which (5) NOW has the force of US law.
No Congressman was ever involved, and Obamba doesn't leave his DNA on it. "Delegation" is ominous for liberty---centers on the writing of administrative law by nefarious types like Saldana and Rodrigues at these federal agencies.
It is patently un-Constitutional (hat tip to FReeper Regulator).
A footnote states that Mexican nationality is granted to children born abroad of a Mexican born parent. IOW, anchor babies born in the US retain parents Mexican nationality.
The Mexican consul/s sworn testimony asserts that: "My responsibilities in this position include protecting the rights and promoting the interests of my fellow Mexican nationals, and, that the main responsibility of consulates is to provide services, assistance, and protection to Mexican nationals abroad."

NOTE This also wipes out anchor babies......and DHS Secy, Jeh Johnson and Obama who say illegals have essentially "become American" b/c they go to school, have licenses to drive, and can even practice law in California.
