ICE Director Gives Shocking Excuse For Failure To Detain Killer Illegal Alien [VIDEO]

U.S. Immigration and Customs Enforcement (ICE) director Sarah Saldana gave a baffling — and seemingly inaccurate — explanation during a Senate hearing on Tuesday for why federal immigration agents failed to detain an illegal alien who killed a 21-year-old Iowa woman in a drunken street race in Omaha in January.

ICE ignored a detainer request made by the Omaha police department last month for 19-year-old Eswin Mejia, Saldana said, because his victim, Sarah Root, had “not passed away” at the time the illegal alien drunk driver bailed out of jail.

That comment appears to be inaccurate since Root died hours after the Jan. 31 crash, in which Mejia was street racing with a .241 blood-alcohol level — three times the legal limit.

Mejia, a Honduran national, left jail on Feb. 5 after posting $5,000 bail. He is now on the run.

It is standard bureaucratic thinking. I bought a trailer on the 13th. The seller put down the 15th on the title. I went to the tag office on the 14th to pay the tax and get the tag. The clerk said you can’t do that until tomorrow because the date on the title isn’t until tomorrow. I showed her the carbon on the check I wrote and she said, “that doesn’t matter. To get the tag today you must get an affidavit from the seller to change the date.” I realized that reason (no potential for fraud) or argument was hopeless. I have dealt with the head of the office and no amount of logic will suffice.

My experience with government officials at all levels is that they have this clerk-like follow-the-rules mentality. You see this periodically with the ridiculous school suspensions for nibbling a pop tart into a gun. It’s a particular mentality that either government forces on officials or only brainless boobs go into government. I’m not sure which.

Pardon me.

I think the cops probably screwed-up asking ICE to detain
the D.D. The D.D. was hold-able under local authority of a county judge....and, certainly, by the police authority, while the investigation was ongoing....and extent of injury unknown.

ICE calls local and state departments to notify THEM of persons that THEY want, who have been arrested and fingerprinted. The local magistrate and or the local cops screwed up, first, and foremost

Add the Root family to the Steinle, the Shaw,...how many more can we name? They need to be on stage with The Donald to drive home the point.

Saldana will not pay for her dereliction of duty, just as Lois never did and Hillary never will.

Prayers for Sarah Root and her family. Sarah had her whole life ahead of her. All you amnesty and sanctuary nuts have blood on your hands.

No matter how incompetent or misfeasant Saldana may seem, she and ICE did not have jurisdiction to order a ‘hold’ on the illegal arrested for the crime: he violated state law, and the county court has jurisdiction to prosecute.

A warrant shall issue for the illegal; and, if found crossing south at the U.S. border, will be returned the the court in the state with jurisdiction, and the aggrieved will have their trial....after which ICE may become involved to provide service, at the state’s request, for execution of sentence, if necessary.

I do not defend Saldana. But the article is throwing stoneage at the wrong agency.

Yes, it seems strange even for a bureaucratic bungle. This was a WEEK after his victim died.

Was there some kind of uncommon pressure brought to bear?

I rest the blame with the county court, or the legislature, which may have bound the magistrate and/ or judge to release under the circumstances at the time.

Which would explain why the municipal or state cops were looking for a federal hero.

The prosecutor could have made...and probably did make..... a case for flight risk. But if it were a first offense, the judge may have been forced to release, no cause having been found to incarcerate pending trial: the bad guy having been painted by his appointed defender....on our dime....as a wayward yoot who lost his way, and was otherwise a productive non-citizen.

Forced?... or chose... Even if so, don’t blame the defender, blame the judge (among others who may have dropped the ball).

ICE consistently screws up detainers, but the local court needs to do its job as well. Illegal status is a good indicator of flight risk, because they have another place to go to avoid prosecution.
