The alternate explanation of extreme stupidity and poor communication is more likely I think.
Never ascribe to malice what can be explained by stupidity.
Organizations just fail to work, in a certain atmosphere - the EPA seems like an outfit run by Douglas Adams’ Vogons.

The agency has since claimed the river is safe for humans, despite state and local complaints.

Really? Any private company would be on the hook for at least a decade to "prove" there was no long term negative effects.

OK, but I’m just trying to figure out who caused the thing to be toxic in the first place.

If I kept a few drums of nasty stuff on my property, illegally, and the cops did something that dumped them into the creek or caused them to blow up a few houses, I bet I’d STILL be the one responsible, even if I told them ‘don’t touch that’. Not arguing that the EPA aren’t fumbling nitwits or a dangerous organization, but wondering if the entity that created the pollution before the EPA came along isn’t to blame, too. Of course could be like the long defunct dry cleaner a quarter mile from my house who contaminated all the well water around here- how do you bring to justice a person or corporation that hasn’t existed for decades?

I think the cradle to the grave responsibility had a origin date as to when the law was passed. If the mine was operational at the time of the law being passed then yes in my opinion as to shared responsibility . Caveat being EPA contracted the cleanup alone in this case to the best of my knowledge thus takes full responsibility regardless of the origin time date etc.

Could be wrong but thats my SWAG on your question.

I looked at google earth satellite pics of Fairplay and massive amount of tailing trails visible that seem to be dredge tracks .... take a peek if ya can, let me know what ya think.

I see that. There may well have been dredging back when. I know there are quarries there these days, rock and gravel. But that middle fork of the South Platt comes right down from gold country.

Speaking of gold, I’m hoping for a charcoal burner bull tag in Buffalo Peaks Wilderness just south of there. Looks like a sweet spot by game dept stats.

Yes, I might be one preference point short, we’ll see.

It’s a good tag, and I can’t keep humpin’ the high Rockies forever. Would love to smack a good bull up by timberline with a muzzle loader.

Otherwise I should get a cow tag for late December close to home. And probably a doe Pronghorn, which means bone up on long shots. {:0)

Excellant !! I’v been bartering for a hunt here in my county for antelope as only landowners get tags to share or sell on their own property. I’ve been watching a herd of about 100 move for the past year. No real pattern but they do stay put for the most part.... odds are good.

As ya suggest, a long shot all way around for me...!!

Been on coyotes for last 90+ days as new born calf is on their menu’s. Using a 300 Blackout Rem 700 with a Surefire SOCOM 7.62 suppressor and a 1.5-5X Mk 4 leupold with the blackout reticle . The load the rig seems to like is the 220gr Gorilla subsonic. Very very quiet......New born calfs are doing fine .....:o)

You ever look back at the Montana Rifle Companies EX2 stainless mausers ?

The spill had been predicted EXCLUSIVE – Geologist Who Predicted EPA Spill: ‘They Just Didn’t Think’ by Geologist Dave Taylor before it happened.

From the first article linked: "The EPA has been less than forthcoming about the results of their tests. Some professionals who have independently tested the water found lead at 12,000 times appropriate levels, others report 3,500 times the limit that is safe for humans. CNN reported that samples of beryllium and cadmium were 33 times higher, and one of the arsenic levels was more than 800 times higher. The EPA has a known history of forcing owners to comply with their demands. They don’t use AK’s, they use outrageous and unconstitutional fines. It’s still force and is well beyond simple bullying.

Another example of EPA abuses of power is in the first article, summarizing how the ...Sacketts were clearing their land to build a dream home in Idaho with all the necessary permits in place when the EPA told them to stop building, restore the land to its original condition, and pay enormous fines because their land was protected wetland even though it wasn’t listed as such on the EPA’s own documents.

Yet another mine spill: EPA Spills Some More Toxic Water from a Mine But That’s Not the Problem by the EPA.
