The answer appears to be yes because (once again), the GOP-controlled Senate voluntarily has left itself vulnerable to the exercise of such presidential power. Article II, section 2 of the Constitution gives the President power to fill vacancies “during the recess of the Senateâ€:
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

A recess appointment would get the GOP off the hook to stand up against Obama and it would make a liberal swing of the court temporary, depending on who the next president is.

The Constitution does not define what a recess is. And there is evidence that it is solely up to the Senate to decide when it takes a recess, corrections welcome.
So if a Senate recess ”forces” Obama to appoint a justice to fill a vacancy, then it is probably because senators decided to use a recess as an excuse to protect their voting records by allowing lawless Obama to appoint a state sovereignty-ignoring activist justice while they were on recess.
Senators protect their voting records in order to fool low-information patriots into reelecting them, patriots who do not understand the federal governments limited powers to tax and spend.

The Senate is currently in recess until February 22. The recess began on Friday. Whether this opens an opportunity for a recess appointment depends upon how Senate leaders interpret an adjournment resolution approved last Friday. That will determine whether it will meet for brief activity during the recess, which could close that opportunity.
So Obama’s selection is blocked and he makes a recess appointment that expires in January 2017. A Republican wins the White House in November and announces his choice to replace Justice Scalia. The Democrats immediately filibuster his nominee, resulting in a recess appointment that last until January 2019. People have talked about the need to do away with lifetime appointments of judged. This may wind up how that finally comes about; through filibuster.
If they are smart (and they aren’t known as the stupid party for nothing, LOL!), they will have 2-3 Senators go conduct Senate business every day from now on, so that he can’t do any recess appointments.
You also have to wonder, if obama would be brazen enough to appoint someone tomorrow or the next day, because the Senate is in recess currently?? He would win over the media by saying the GOP pledged to block any nominee of his, so he would justify it based on that. Liberals and media would carry this message of GOP obstruction.
Of course BO will take advantage of the crisis he, IMO, orchestrated. These are not nice, warm Christians. Consider the depths of depravity of Lucifer’s lieutenants.
