Too early to comment on the talk shows but I expect all of their talkers to be presenting the Republican debate last night in whatever biased view fits their own agenda. I caught only the last half and was impressed with the genuine outrage expressed by Donald Trump at the misrepresentation of his positions on eminent domain, planned parenthood, business bankruptcies and more. He said PP does some good things but abortion is not one of them. He is adamantly opposed to abortion. Anyway, I saw a man who will protect America and her people with a fire and energy and passion supported by intelligence and experience that is now very personal for him. Trump has gotten into the raw, bare knuckled politics which brings out the true metal of the participants. I have less respect for his opponents who ride on his coattail than I had before the debate, which was not a lot, and more confidence in his ability and dedication to do what he campaigns on, that being taking back America. GO TRUMP.

If they had REAL guts, they’d simply have a roll call and vote NO on every nominee Obama sends.

They would absolutely be fulfilling their Constitutional duty in doing so.

If they put off a vote, the democrats and press will attack and hound them every day.

I don’t think any one disagrees about getting news elsewhere, but we don’t watch these shows or have this thread just for news.

It is opposition research. We want to know what lies the democrats and press have collaborated on, and being the election season, listen to our various candidates handle the “gotcha” questions democrat-driveby hosts try to hammer them with.

A lot of Sanders and no Cruz. With the debate last night and Scalia’s passing (RIP), most anything said on these shows recorded Friday is moot.

Technically, the process is nominate - then advice and consent - then appoint.

So, he can nominate anybody, but he can only appoint who the senate approves.

Grassley, head of Judiciary Committee (where hearings are conducted) has said "no." As you point out, there will be public pressure, from both sides. However, the GOP is up for election in November, and the peasants are revolting.

Recess appointment of SCOTUS judge is possible, but really frowned on by the Senate. Unlikely to happen. Requires a recess (of course), and the Senate is in one now, and likely will be at other times between now and next January. Any recess appointment expires with the expiration of this Congress, that is, in January of next year.

Simply put, the US Constitution, Article 2, Section 2:

He (the President) shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.
The Senate doesn't have to recess until after the new President and Congress are sworn in.

The Constitution provides for a way to limit the powers of the president for a reason. The Founders didn't want a king, and they read about Julius Caesar's rise to power under the Roman Republic. It is up to Congress to use their Constitutional authority when necessary.

The Republicans can do that, even with an opposition party press trying to beat them with false outrage.

This administration is doing everything it can during its last few months of power, including lambasting police, eliminating death penalties that ISIS can infiltrate America with little bother.

If you don’t think they’ll take a stab at a recess appointment I got a bridge to sell, cheap. Sways a bit in the wind but mostly in good shape.

The key here is, WATCH THE ESTABLISHMENT WIMPS IN THE SENATE!

They should never take a recess and if they do I will always believe it was to allow Obama a Supreme nominee.

Will the Pubbies have the guts to pull a Bork on the next Obama appointee - I’m not so sure. However, if they don’t I see a potential pitchfork uprising by a lot of us out in the fields.

From what I’ve heard on TV, there is a precedent for not approving a SCOTUS appointee of a Lame Duck Prez (IIRC about 80 years). Also, there is nothing written about the number on the SCOTUS, so if we have 8 rather than 9, perhaps not an issue from that perspective, but could mean tied votes or worse for upcoming cases like immigration, Little Sisters of the Poor, etc.

Does this mean that Barack is prohibited from making a recess appointment during the 23 days or however many days, he remains in office, before the new POTUS is sworn-in along with the newly elected Senate, which may or may not be a GOP majority?

Hi Pat,

I agree they shouldn’t take a recess and may not. One thing that I’ve heard (and honestly don’t know much about) is Jan 3 to Jan 20, 2017 where the Senate is automatically out (I guess until the new senators are sworn in). I worry about Obummer trying to put a recess appointment in at that time. Folks on TV have said he shouldn’t even try it, given that the SCOTUS ruled that he couldn’t do a recess apt on the FCC or FSLRB (think it was the latter, but don’t recall right now). I think there is absolutely nothing that Obummer (and his puppet masters, ValJar and Soros)won’t do. He’s leaving office - what does he care, except lately he seems to care about his legacy and this will be one more notch in his belt, or so he thinks. I just hope Ruth BG hangs on for another year.
