Supreme Court refuses to take another Obamacare case

The Supreme Court refused Tuesday to take up an appeal that says Congress flouted the Constitution by kick-starting Obamacare in the wrong chamber.

Justices have already weighed in on the Affordable Care Act's mandates, government subsidies and birth control rules, but declined to wade into a bid by a conservative group to scrap the entire law based on the origination clause drafted by the Founding Fathers.

The Pacific Legal Foundation said the Affordable Care Act of 2010 raises hundreds of billions in taxes, making it a revenue bill subject to the founders' vision for which chamber should act first.

Since the key language of Obamacare came from the Senate, opponents said it violated another part of the Constitution that requires money bills to begin in the House.

Lower courts said the main purpose of the law was to get more Americans insured - not to fill the Treasury's coffers - and that Congress used an acceptable maneuver to bypass the clause, anyway.

The U.S. Court of Appeals for the D.C. Circuit rejected his (Plantiff, Mr. Sissel) suit in August, saying the primary purpose of the law wasn't to raise money.

It seems none of these legal geniuses recognize wealth redistribution when it stares them in the face.

It used to be that United States Senators were elected by the state legislatures, but the 17th Amendment changed that and established the popular election of Senators by the people of the states, so that kind of made the origination clause moot.

And yet the basis on which they upheld the individual mandate was that the bill was a tax and permitted under the taxing power.

So which is it? Is it a revenue bill or something else?

It drives me nuts to see those HHS commercials on tv where they show people who have signed up for Obamacare and the huge premium numbers x-ed out and a small number shown.

They never mention that it’s wealth transfer. Pure vote-buying.

They refuse to take on Obamacare or usurper’s eligibility or anything else that might take him down. I dunno but there might just be a pattern here.

Although I have disagreed with the SCOTUS’s two main rulings on Obamacare, I don’t think we can ever count on the SCOTUS to overturn bad legislation.

The Democrats have been promising national health care since the days of Harry Truman.

If you don’t like this type of legislation, then don’t vote for Democrats for anything for any reason. The people of this country are responsible for BHO getting elected and for giving him overwhelming majorities in Congress in 2008.

Democracy sucks. I know. If it were up to me, we could go back to the limited government constitutional republic established by our Founding Fathers.

Well, they’re 0 for 2, so maybe they don’t want to actually strike out.

SCOTUS is so bad. Not only are their decisions generally unconstitutional, but the assumed scope of the effect of their decisions are also unconstitutional. The Constitution NEVER granted SCOTUS power to make national law. The authority of their decisions are limited to individual cases and controversies and as precedent for other cases and controversies that have the same facts and questions of law IF the original decision was constitutionally based.

Congress should pass a law requiring every justice to be enrolled in Obamacare.

See how long that takes for a reconsideration of the Affordable Care Act by the justices?

The entire government congress, courts, legislature, executive entities, are all in cahoots with each other to socialize our nation and they for once and for all need to be TRUMPed!

BYW, none of them have the bullshit, cost and hassle of ACA nobama care It’s them tyrants against we the people peasants - and they are the ones that made and started the formal distinction. If the colony’s had acted as we are now (doing nothing about anything and there are lots of thing that need to be put down) we’d be still bitching about the crown!

:) What he said...see the solution is so simple and entirely in the hands of the electorate. The mess were in is of our own making. We shouldnt look to the pols and blame them. Most were upfront about their leanings. The voters either agreed with that or didnt bother to educate themsevles. So, were here becuase of us.

I remember at the time thinking that it violated the origination clause.

But they insisted that it was not a tax. But then the Supreme Court decided that it WAS a tax (for constitutionality purposes.)

In short, our constitution means nothing except what our elites say it does.
