III

110th CONGRESS

2d Session

S. RES. 511

IN THE SENATE OF THE UNITED STATES

April 10, 2008

Mrs. McCaskill (for herself, Mr. Leahy, Mr. Obama, Mr. Coburn, Mrs. Clinton, and Mr. Webb) submitted the following resolution; which was referred to the Committee on the Judiciary

April 24, 2008

Reported by Mr. Leahy, without amendment

April 30, 2008

Considered and agreed to

RESOLUTION

Recognizing that John Sidney McCain, III, is a natural born citizen.

Whereas the Constitution of the United States requires that, to be eligible for the Office of the President, a person must be a "natural born Citizen" of the United States;

Whereas the term "natural born Citizen", as that term appears in Article II, Section 1, is not defined in the Constitution of the United States;

Whereas there is no evidence of the intention of the Framers or any Congress to limit the constitutional rights of children born to Americans serving in the military nor to prevent those children from serving as their country’s President;

Whereas such limitations would be inconsistent with the purpose and intent of the "natural born Citizen" clause of the Constitution of the United States, as evidenced by the First Congress's own statute defining the term "natural born Citizen";

Whereas the well-being of all citizens of the United States is preserved and enhanced by the men and women who are assigned to serve our country outside of our national borders;

Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President; and

Whereas John Sidney McCain, III, was born to American citizens on an American military base in the Panama Canal Zone in 1936: Now, therefore, be it

That John Sidney McCain, III, is a "natural born Citizen" under Article II, Section 1, of the Constitution of the United States.

Amazing!

Obama is not even an American citizen, but the
GOP and SCOTUS protect him against real Americans —
even as the cryptoMoslem has systematically disemboweled
America and aided al Qaeda, the Moslem Brotherhood,
and every Islamic terrorist he can.

McConnell: No, Senate won’t pass resolution affirming Cruz’s eligibility like it did for McCain
http://www.freerepublic.com/focus/news/3382813/posts

Why can Mc-Conman do this? Because he has a revered creep — Professor Laurence Tribe, undermining Cruz [regarding natural born status].

Tribe is a creep, but his constitutonal fig leaf is large enough to shield Mc-Conman.

So ... Cruz is a martyr who might get more support during the primary from this, but if he wins the primary ... it gets ugly in a bipartizan way — establishment cocktail conservative republicans writing talking points for the left.

Whereas John Sidney McCain, III, was born to American citizens ...

Obama freely admitted, and told anyone who would listen, that his father was a British Subject of Kenya.

Somehow, that simple fact, was missed by all of the genius’s in the Senate.
We are led by stupid people

Senate Majority-Traitor McConman already threw Cruz under the bus on this option. [Link above.]

The cage fight continues.

Original intent v. Cruz and ‘equality of women’.

It’s a no-win either way for conservatives.

The judges will rule on behalf of ‘equality of women’, and then the democrats will quote Tribe and anyone else who knows how to figure out original intent. College radicals and the New Black Panthers will suddenly become the ‘defenders of the constitution’ even though it flies against equality for women. Hypocracy, but just the kind of confusion the Ruling Class wants.

A divided nation. Not good.

If Cruz weren’t such a great candidate, I’d have thrown him under the bus on this utterly and without compassion.

As it is?

I hope we can nudge Cruz supporters both gently and effectively. One way is to support an amendment to make Cruz eligible. At least they would then know we respect him as a patriot.

FRegards ....

Actually, Cruz could point to Obama and claim, by extension, he should also be okay.

At least, then, Cruz would take down Obama.

The senate has their own lawyers. They do not rely on Tribe
BYW while looking for links Tribe presented several situations where Cruz praised him before this issue came up. Can you find any of those ?

Senate Majority-Traitor McConman [who openly declared war on the Tea Party] has an infernal fig leaf ... Professor Laurence Tribe.

Cruz’ general criticism of Tribe is correct, but Cruz never touches on what Tribe says specifically ...

Ted Cruz’s fmr. professor says Cruz is a hypocrite on the Constitution VIDEO
http://www.freerepublic.com/focus/f-news/3384690/posts

Thursday following FBN’s broadcast of the Republican presidential debate, Harvard constitutional law professor Laurence Tribe attacked Sen. Ted Cruz ... for his stated on reasoning for his eligibility to run for president of the United States.

According to Tribe, Cruz applies a double standard to his interpretation of the Constitution, to which he deemed Cruz to be a ‘constitutional opportunist’ and a ‘hypocrite.’

‘I’ve done a lot of historical research on it, and so have a lot of other people, and the best evidence seems to be that what they meant... ‘

[snip]

“The funny thing is, that the kind of guy Cruz is, he’s always been this way. When he was my student he was this way. He’s always said the Constitution always means the same thing that it meant when it was adopted. That’s why he made this funny joke to Trump, you know, saying, the Constitution didn’t change since last September. Well, he thinks it didn’t change since 1788 when it comes to gays and, you know, women and other things. But when it comes to his own ambition, he’s suddenly becomes what he accuses me of being, and it’s a pretty true accusation, a judicial activist. That’s not the guy he is normally.”

Obama did this to establish legitimacy for himself. Obama and Clair McCaskill did this little exercise, so the way would be paved for Obama to avoid legitimacy challenges.

McCaskill is more than a little responsible for our being ruled by Obama.

Crap. with paragraph breaks would help ...

A funny thing about this resolution, and you would think legislators would know how to legislate, but what is says, and what it concludes, are opposite. The resolution contains a HUGE lie.

Whereas the term "natural born Citizen", as that term appears in Article II, Section 1, is not defined in the Constitution of the United States;

Whereas there is no evidence of the intention of the Framers or any Congress to limit the constitutional rights of children born to Americans serving in the military nor to prevent those children from serving as their country's President;

Whereas such limitations would be inconsistent with the purpose and intent of the "natural born Citizen" clause of the Constitution of the United States, as evidenced by the First Congress's own statute defining the term "natural born Citizen";

So what if NBC isn't defined. Is citizen defined? Yes, see Art IV, Sec. 2. Citizens of a state are citizens of the union. Maybe McCain fits there, I don't know.

Citizen also appears in the 14th amendment. Born in the US, or naturalized. McCain wasn't born in the US. So, if he's a citizen under the 14th amendment, he's a naturalized citizen.

We don't even have to worry about the definition of NBC.

I'm going to skip over that second paragraph. It's functional nonsense anyway, BC the founders didn't expect us to have our military scattered all over other people's countries.

The third paragraph is a bold-faced lie, and any legislator that is worth a shit knows it.

I can point to a US regulation that says "A 22 year old shall be considered as a child" Does that define "Child"? For legal purposes it does, but that child is still a 22 year old.

Naturalization act of 1790 ...

And the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens
That's not definition, it is the opposite of definition!

Ask every single drafter of legislation, ask the pros. When they use that phrase, how does it operate?

Our lyin' Senate, pulling the wool over the people's eyes.

And lyin' Cruz, Kaytal, and Clement, and a host of others, Mark Levin, I'm looking at you too, Limbaugh? Settled law in favor of Cruz? No way. No way. Se Rogers v. Bellei, and stop spinnin' yer arse off.

Nancy P certified for Obama of course she left the paragraph out that he was qualified FRAUD.
That is why “Ask-for-the-BC Trump” is wanting this to be settled law. It will completely wipe out the fraudulent Democrat Party

IF obama was born in Hawaii...his case for NBC is stronger than Cruz’s.

This is getting very problematic.

I didn’t realize until this week that Rafeal was not a US citizen when Cruz was born.
