Viewing that penalty as clearly unjust given the facts of the case, U.S. District Judge Michael Hogan instead imposed sentences on Dwight Hammond, and on Steven Hammond. The terms were within the ranges recommended by federal sentencing guidelines that would have applied but for the statutory minimum, which Hogan rejected as inconsistent with the Eighth Amendment.
A simple solution to the entire mess:

What is also clear is that, 4 days in, they are running out of resources.
The power will be cut, they will run out of generator fuel, they are already asking for food donations and those won't matter as soon as the police close the roads.
They are about to go on the Malheur diet.
They didn't plan this very well.
Their best bet is to admit the locals don't want them there and get a good lawyer to negotiate a plea.

Commute the sentences of Dwight Lincoln Hammond Jr and Steven Dwight Hammond, both of Harney County Oregon.
Dwight and Steven Hammond were tried in Federal Court for arson on Federal Lands. The trial judge at sentencing felt the mandatory 5 year sentence was cruel and unusual and gave them lesser sentences. The Hammond’s served that sentence and went home. The Federal Prosecutor appealed that sentence and won in Appeals Court to re-sentence the Hammond’s to the Mandatory 5 years (with time served). The residents of Harney County believe that they have served enough time and are asking the President for a commute of sentence for the remainder of the Appeals Court Sentence. Other citizens of these United States, also believing the Hammond’s have served enough time, are also signing this petition.

Sounds like they are splitting up. The CNN reporter said some were going to the Hammond ranch while others would be sticking it out there. Also, according to the reporter, it sounded like one of the protestors isn’t intending on leaving alive.
