Open carry comes to Texas: Why the Lone Star state will be safer in 2016

With about 900,000 concealed handgun permit holders in Texas, there is a good chance that someone next you in a Lone Star State grocery store or restaurant is carrying a concealed handgun. Starting Friday, Texas will join 44 other states that already allow people to openly carry handguns throughout the state.

I'm curious: I just saw on the local news that if you are open carrying, a business can ask you to leave. Really? Isn't that discrimination? Didn't a bakery just lose a significant amount of money, along with their business, because they refused to be a part of a lesbo wedding?

In Texas businesses have always had the option of posting a 30.06 sign which prohibited concealed carry on the premises.

With the new law they will have the option of a 30.07 which prohibits open carry on the premises.

So they can post a 30.07 but not a 30.06 and you can carry concealed but not openly. In this way they can play the fence between responding to customer who think guns are scary, and acknowledging the right to carry - concealed.

Regarding the comparison of Right To Bear and "Make my damn cake" - yup.

Yes. If the business posts a 30.07 only, you can still carry concealed.

I believe the bakery you're referring to was in Oregon, not Texas.

And yes, they can ask you to leave if you aren't in compliance with their posted signage, because that 'right to refuse service' door swings both ways.

My question is now that they have open carrfy.
Some has concealed carry.
Can you then conceal a weapon without a permit there now?

All Concealed Handgun Licenses are converted to Open Carry Licenses. The license requirements have not changed, so no, unlicensed carry is still illegal. Time to press for Constitutional Carry, but I'm happy with at least moving in the right direction.

1. Can you open carry at a lesbian wedding?

2. Can you open carry in a muslim business?

3. Can you open carry while riding a bicycle while wearing only shorts?

Inquiring minds want to know...

If your piece is effectively concealed it does not matter what the sign says. If you stop an armed robbery it likely will still not matter what the sign says.

Wondered if there was a conversion. Guess I am now practicing to pass my “license to carry”. Constitutional carry is as it should be, but you know the thought of that gives most libs chest pains.

The salient difference is that you don't have to spend your money at that place so the choice is yours if you wish to comply by disarming.

In the other case, the place is having its rights taken away by being fined for following their religious beliefs.The second case is a absolute breach of the Constitution because the owner's rights are taken away to enforce "rights" that don't exist in the Constitution by violating rights that do exist in the Constitution.

But you already knew all that - I just needed to rile myself up again....

Makes it all the more important to try to get a conservative in the WH this time around...

Now for a short public service announcement to all on FR:
We need to ensure we don't get another Obama-like America Hater as the next President.
The best way to ensure that is to actively support a candidate as the next President.
I prefer Cruz and my money goes to his campaign, hence the Cruz link. If you like someone else, donate to him/her (find your own link to do it) and if you use FR and don't donate, then please don't complain about the welfare leeches or those who have Obama Phones because, functionally, you are no different than any other who enjoys the fruits of others' work for your own benefit.

Businesses must post a no open carry sign in accordance with the requirements of 30.07. Just a “No Open Carry Allowed” or pistol with a circle and cross line isn’t sufficient to get you a misdemeanor charge if you don’t leave when asked.

Then again, always good idea to follow up with a phone call to the business telling them you were turned away and won’t be visiting their establishment again.

From the Texas Dept of Public Safety website:
“Effective January 1, 2016, it is a Class C misdemeanor punishable by a fine not to exceed $200 for a license holder to carry a concealed handgun onto private property after receiving effective notice under §30.06, Texas Penal Code, or to openly carry a handgun onto private property after receiving effective notice under §30.07, Texas Penal Code. Note, after January 1, 2016, the offense will be enhanced to a Class A misdemeanor if it is shown at trial that, after entering the property, the license holder was personally given the notice by oral communication described by Subsection (b) (of §30.06 or §30.07)and subsequently failed to depart. “

The existing Concealed Handgun License (CHL) will include open carry as of January 1, 2016.

The new version will be the License to Carry (LTC) and is supposed to be issued to current CHL folks when they renew their permits starting sometime in 2016. New licensees should be issued the LTC card when they qualify.

A business may post a ‘30.06’ sign by the door to ban concealed carry on the premises or a ‘30.07’ sign to ban open carry or both signs to make their establishment a gun free target zone.

Those two restrictions are in addition to the other current rules as to when and where a firearm may be legally carried.

It will be interesting for a while as the whiny liberals go all panty-twisted hysterical and try to SWAT open carriers!

I wouldn’t open carry anyway but one advantage I see is not worrying about ‘printing’ or your shirt riding up exposing your piece as you bend over or reach for something.

I recently moved.

In my previous state, you could open carry without permit or concealed carry with permit but if you concealed, you were not allowed to print without risk of losing you concealed carry permit. State law let you open carry almost anywhere and the law prevented local authorities from bothering you.

In my current state, you can legally open carry but will likely get hassled if you are in the urban regions. If you have a concealed carry permit, you can print all day with no repercussions.

A minor difference but seems strange.

Well, I have no doubt that the knowledge on the part of criminals that law abiding citizens are openly carrying here in TX will serve as an additional crime deterrent, but it will take a while to get used to seeing the guns on display so openly.
