Levin’s Article V effort would be of the cold variety.

On the other hand, any Article V effort could potentially precipitate the hot kind. It would be important to be aware of the possibility.

Per this EPA press release, he was dealing with 10 tons of sodium, and they claim he stored it improperly.

I don’t know any more than that...but the original article gave me the impression he just mailed one box of sodium. Seems like he tried a business venture that didn’t pan out, and didn’t have the means to store the unused sodium to the EPA’s liking.

I use it to clean engine blocks that fail on dyno and etch the aluminum. I’m sure its not pure sodium and I am no chemist but some type of mixture added to water in a tank that has the word sodium in it.

I add the mixture in very small amounts to the water... veeeerrry slowly... like 1/2 cup at a time in 10,000 gallons of water and still get a reaction.

No he went to jail for shipping the sodium via air. Would you want your family on an aircraft that was transporting sodium? BTW he needs to sue UPS if indeed the packages were labeled correctly. EPA and DOT rules and regulations make it the shipper’s responsibility to insure no violations occur but UPS seems to be at fault if they didn’t inform him that aircraft would be used in “ground” shipments. What it boils down to is that we are ALL criminals, the only distinction is between indicted and UNindicted criminals. There is NO possible way to live in the USA today without breaking the law and I would say breaking it on a daily basis. In addition you may be thrown in jail for some trumped up charge that really is not a violation of any law. This is a dangerous situation and growing worse daily. The only thing preventing a blowup is that so many people don’t seem to realize just how bad the situation is. There are a lot of people who are considered pillars of their communities and rightfully so who would be astounded to learn that they break the law on a regular basis without any knowledge of the fact. To listen to the rhetoric coming from left and right it seems that a lot of our supposed “leaders” have no interest whatsoever in correcting this problem, preferring instead to think up more reasons to throw people in prison.

So the guy who is the subject of this article is claiming that his lawyer was incompetent, and the article is about an abusive EPA.

If it's OK with everyone here, I'm going to wait a couple of years and then check back in on this thread after all the facts come out.

No, but I wouldn't ship my family via UPS, which is the only way they'd end up on a UPS flight.

The only response that I can come up with right now is, “ Before you point out the speck in your neighbor’s eye, remove the log in yours.” I can’t fault no one but me. On the bright side, my question was answered.

Nobody ships 10 tons of anything point-to-point via UPS.

Good digging in to this -
The defendant may be a smart guy of good character, but he sure used awful judgement in walking away from 10 Tons of Sodium he was responsible for, which is how Superfund sites occur. Storing 10 tons of Sodium is a Huge problem for a property owner, and an even bigger problem for fire fighters if it caught fire.
Can you imagine the explosive carnage that would have resulted from firefighters putting out a sodium fire with water?

United States of America vs. Evertson. This federal indictment involved complex chemical engineering, innovative manufacturing process improvements and patent issues. Based on evidence collected during FBI and EPA investigations, the defendant was indicted in the US District Court in Pocatello, Idaho. The US government alleged that the highly explosive nature of 10 metric tons of alkali metals was an imminent danger and triggered an immediate CERCLA response.

I wonder what this man's legal bills were.

Even if found completely innocent of everything ( he was the second time) the process itself is punishment both emotional and financial.

This is the problem the Hebrews had trying to follow all the made up administrative rules and laws in order to satisfy God?

Their religion created so many administrative laws that it became impossible to follow all of them. They sought the Messiah to relieve them of the onerous laws imposed by their religion. Most Hebrews accepted the Messiah and his two commandments when he arrived.

Article. I.

Section. 1. All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.

very dangerous. so dangerous that in high school, my teacher gathered the class around a table for a demonstration. A pea sized piece was placed in a bowl of water and we watched it smoke, bubble and spin burning. somehow, we survived. Afterwards, he put the rest of the jar away in a cabinet in the classroom.
