Clearly he needs to be removed from office and disbarred.

Morrissey continued to pursue those charges even after conceding that such activity is protected by the First Amendment.

Of course he did. The process is the punishment and it will continue until we change the laws to let scum like this prosecutor suffer personally for their transgressions.

Passing out pamphlets seems protected even though jury nullification is a spreading loony idea typical of our times. Most advocates hear the words and immediately agree all without thinking its consequences through.

Someone correct me if I am wrong but I thought a Government official is not protected from being sued for intentionally violating someone’s civil rights under the color of law.

Sue his ass off.

I've been called to jury duty twice in my life...wasn't selected to hear a case either time. But if I ever serve on a jury I'll certainly keep in mind my right to judge the *law itself* as well as the evidence presented during the trial.

"Hate crime" charges come quickly to mind.If the evidence shows that a white guy assaulted a black for no good reason (and being black surely isn't a good reason) I'll vote guilty on the assault charge(s).But I won't vote guilty on any charge connected to the *motive* for the assault.
