It just doesn't make any sense to me someone would go through all that and not think it out.

Does it make any sense that any one would break into a house via a chimney?

Just break a window, {and I'd shoot you} and come on in.

Agree....... But the story indicates the family didn’t know the deceased was in the chimney.
Apparently he was stuck in the chimney for almost a day. Strange to say the least.

“Legal theory”, well there is no real standard they could sue over. However, they could try a civil case stating that the owners should have covered the chimney with something to keep “kids” from fall into them.

I suppose anything is possible. If the burglar had fallen off the roof and died of a broken neck, should the homeowners be sued because they didn't have netting around their house to catch a falling kid? As I said, an age of insanity.

Don't believe it....I got stuck between two masonry walls...it was funny for the first one minute....you panic like you are drowning....The words OMG...said it all

What they probably didn't realize is that he was really stuck.... and thought the fire would bring him down....

He dies...of course they're going to lie through their teeth. They have the advantage. Dead men tell no tales.

They would have to prove the home owner knew he was there before they started the fire.

The only witnesses are the residents of the home.

By definition, a burglar uses stealth to enter a home, that stealth would prevent the home owner from knowing the man was in the fireplace until after the fire was started.

Unless someone in the home is an idiot and admitted they knew he was there, they cannot be sued for starting a fire in their own fireplace.
